January 8 CPI depends on Congress session – 02/28/2023 – Panel

Even with enough signatures to start the processing of the CPMI (Mixed Parliamentary Commission of Inquiry) on January 8, its installation still depends on the holding of a session of Congress, which does not have a date to happen.

On Friday (24), rookie deputy André Fernandes (PL-CE) announced on a social network that he had obtained the required number of signatures — one third of senators and one third of deputies. He is one of three parliamentarians investigated for encouraging acts of vandalism in Brasilia.

Even so, for it to actually get off the ground, it is necessary for the President of the Senate, Rodrigo Pacheco (PSD-MG), to call a session of Congress, rarer than that of each legislative House individually.

These sessions are convened to analyze vetoes and deliberate on the Budget, for example. In 2022, only eight were summoned to deliberate agendas.

The government of Luiz Inácio Lula da Silva (PT) has no interest in seeing parliamentary investigations into the attack on the headquarters of the Three Powers. In addition to being impossible to predict the path they might take, they end up sucking attention from the legislative agenda, in a year when the Lula administration has other priorities, such as tax reform.

Pacheco, however, is under pressure to proceed with the installation of the collegiate bodies. This Monday (27), the Minister of the STF (Federal Supreme Court) Gilmar Mendes determined that the President of the Senate explain why he has not yet installed the CPI proposed by Senator Soraya Thronicke (União-MS), which already has 39 signatures.

Understanding of the Court determines that, in the presence of signatures and determined fact, it would not be up to the President of the Houses to postpone the installation. In this case, Senate sessions are more frequent and occur at least three times a week.

The government has other instruments to prevent progress. It can articulate with the parties not to indicate the parliamentarians who will compose the committees. In this way, the operation becomes unfeasible.
