It’s time to calm tempers between the Powers – 10/06/2023 – Dora Kramer

Congress and the Federal Supreme Court must be called upon to exercise moderation. Appeal to the observance of the major assumption of politics in its noble sense: the construction of consensus from dissent.

Institutions that —each in its own way and degree of intensity— protected legality, faced the coup attacks of a President of the Republic and, thus, strengthened democracy, now act to weaken it.

Frictions are normal between Powers, as they are independent. Friction in the form of pedestrian conflicts violates the precept of harmony. This is what we see in the conflict between Parliament and the highest court of the Judiciary.

It shouldn’t have happened, but it did. And here what matters least is who started it, who shouts the most or who is least right. Both have their motivations (honorable and/or dishonorable) which, however, do not justify disputes for protagonism.

The STF fails to exercise self-restraint and Congress does not hold back from provocation. There are undeniable exaggerations in the court, as can be seen in certain decisions, notably monocratic ones, and in the evident political engagement of some judges.

Parliamentarians, for their part, intend to interfere in the functioning of the court and to do so go beyond proposals known to be unconstitutional just to affect combativeness.

There is a hint of exhibitionism on both sides, undisguised even in the mild words of the commanders of the Powers. The soft speeches are contradicted by the restlessness of the actions that every day add a point to the friction.

To get where? What destination will the tug of war lead to? Whoever wins this or that specific dispute gets what type of trophy? There are no winners on this horizon where instability thrives without results.

We will all lose if your legislative and judicial highnesses do not put this ball in the ground in the name of the smooth running of institutional work.
