Minister defends implementation of the measure in one year

Manaus (AM) – Minister Cristiano Zanin, of the Federal Supreme Court (STF), voted, this Thursday (10), in favor of the implementation of the mechanism of the judge of guarantees by the Judiciary throughout the country. The model predicts that the magistrate responsible for the sentence is not the same one who analyzes precautionary measures during the criminal process.

In the first vote given after taking office at the STF, Zanin defended the implementation within a year and stated that the effectiveness of the mechanism will change the course of the Brazilian Justice to guarantee impartial judgments.

Before arriving at the court, the minister was a lawyer for President Luiz Inácio Lula da Silva in the Lava Jato Operation processes and managed to prove the partiality of former judge Sergio Moro, annulling the accusations.

“I am convinced that the existence of the guarantee judge could effectively change the course of Brazilian justice, because by guaranteeing the Brazilian population a greater probability of impartial and independent judgments, the penal system is potentially fairer. The impartiality of the judge is the supreme principle of the criminal procedure.

The minister also pointed out that the mechanism will help combat racial injustices in the penal system.

“There are around 650,000 people in prison in the country. Incarceration mostly affects young people up to 29 years old, black, with a low level of education”

The voting score is 2 votes to 1 for the deployment of the guarantee judge. The trial has been adjourned and resumes next Wednesday.

In addition to Zanin, Dias Toffoli also spoke in favor of the mechanism. Only the case’s rapporteur, Luiz Fux, voted for the optional implementation by the country’s courts.

The adoption of the guarantees judge was expected to come into force on January 23, 2020, according to the Anti-Crime Package approved by the National Congress. However, it was suspended by an injunction from Fux. Now, the Supreme judges the case definitively.
