The images obtained by the report would be the sharpest so far and were captured. Daniel Alves’ lawyer, Cristóbal Martell, claims that she is the 23-year-old who goes to the bathroom when the player is already inside the place.

However, in two other videos it is possible to see white sneakers and the silhouette of a man wearing a shirt of the same color that the player was wearing that night. It is noteworthy that access to the site was restricted to people who were in the VIP area.

In early January, the player gave an interview to the program “Y Ahora Sonsoles“, from Antena 3, in which he confirmed that he was in the same nightclub as the woman who accuses him, but denied having touched the complainant without her consent and said that he did not even know her. In his first statement, however, the athlete stated that he was with the woman, but without sexual intercourse.

Later, he admitted having had sex, but claimed that the relationship was consensual. According to the Spanish press, he claimed to have changed his version several times to try to hide the infidelity of his wife, the model Joana Sanz.

This Tuesday (21), the Court of Barcelona rejected the 39-year-old player’s request for provisional release. For the three judges responsible for the case, Eduardo Navarro, Myriam Linage and Carmen Guil, there was a risk of fleeing to Brazil because of their economic capacity and this weighed in when it came time to deny the appeal. In addition, according to them, there are several indications of the crime committed by the player.

Daniel Alves has been held in custody since January 20 at the Brians 2 Penitentiary Center in Barcelona. There is still no date for the trial.

SPANISH CRIMINAL CODE

Spain’s Penal Code was amended in October last year with a new law based on the idea that sexual crimes must be typified based on the victim’s consent. Thus, all crimes of a sexual nature, regardless of whether or not there was violence, became “sexual assaults”.

The law, called “Only yes is yes”, was created to expand the scope of the crime of sexual violence. All non-consensual sexual acts were now considered violence. Contradictorily, however, sentences for some sexual crimes have been reduced.

The penal code of Spain considers sexual aggression “acts of a sexual nature that are carried out with recourse to violence, intimidation or abuse of a situation of superiority or vulnerability of the victim”.

The penalty provided is from one to 15 years for crimes of sexual assault, depending on the severity, but it can also be reduced to fines.

DANIEL ALVES CASE

Daniel Alves had his arrest decreed on January 20. He was arrested while giving testimony about the case of sexual assault against a woman in the early hours of December 30. The Public Prosecutor’s Office asked for the 39-year-old athlete’s preventive detention, without the right to bail, and the holder of the Investigative Court 15 of Barcelona accepted the request, ordering the detention.

The accusation refers to an episode that allegedly took place at the Sutton nightclub, in Barcelona, ​​Spain. The athlete, who defended the Brazilian team at the World Cup in Qatar, allegedly locked, assaulted and raped the whistleblower in a bathroom in the VIP area of ​​the nightclub, according to the newspaper. The security team at the nightclub called the Catalan police (Mossos d’Esquadra), who took a statement from the victim. A camera worn on a police officer’s uniform accidentally recorded the victim’s first version of the case, corroborating what she said in the official statement.
