Hacker arrested by the PF studies making a plea bargain against Carla Zambelli

Hacker Walter Delgatti, arrested this Wednesday morning (2) during the Federal Police operation that carried out search and seizure warrants at addresses linked to federal deputy Carla Zambelli (PL-SP), is studying closing a prize-giving agreement with the authorities.

He is being investigated for involvement in an alleged scheme to invade and challenge the security of electronic voting machines in the 2022 elections. ”, says he was hired by the deputy to carry out the fraud last year.

However, he would not have been able to access the ballot box code, but managed to access the systems of the National Council of Justice (CNJ), where he inserted false documents of release and prison permits of Minister Alexandre de Moraes, of the Federal Supreme Court (STF). ).

According to lawyer Ariovaldo Moreira, who defends Delgatti for this Wednesday’s arrest (2), the hacker would be studying an award-winning delation about the scheme, provided he can prove the accusations already made in the testimony to the Federal Police in June, when he was arrested.

“I’m going to be with Walter today, we’re going to talk during the custody hearing at 5 pm, try to align if that’s really what he wants, if he has proof about it. Because an award-winning delation is not enough for him to speak, narrate the facts. He has to prove, at least evidence evidence. If Walter understands that this is the opportunity to clarify what really happened, the real will, I am willing to be at the forefront of this accusation”, he said in an interview with GloboNews.

Delgatti’s defender claimed that the hacker was at the Ministry of Defense several times to supposedly work on the audit commission that had been set up to oversee the electronic ballot voting system. A little earlier, Carla Zambelli confirmed that Delgatti met with former president Jair Bolsonaro (PL) and that he was asked about the security of the ballot boxes, but denied that the hacker participated in anything else afterwards.

“According to him, yes, he was at the Ministry of Defense and he says he has proof of that”, he said, reaffirming that the proposal to serve on the commission was made “by Carla Zambelli”. Ariovaldo also said that the letter from the ministry sent to the Superior Electoral Court (TSE) with questions about the security of electronic voting machines was written by Walter Delgatti himself.

“According to Walter, he did it. All those questions were asked by him. […] This is the narrative, Walter’s narrative, when he was convinced of the arrest warrant for Minister Alexandre de Moraes, he gave me details of how it was done”, he concluded.

Payments outside official channels

According to the investigations, the amount that Carla Zambelli would have paid Delgatti to provide the alleged service of attempting to invade the electronic voting machines and, later, the CNJ systems, was R$ 13.5 thousand reported by him in the statement to Federal police. However, Ariovaldo Moreira claims that it would be even more, somewhere around R$ 40,000 to R$ 45,000, in which the hacker’s brother would also have been paid.

Carla Zambelli said that Delgatti had been hired to provide services to improve her website, such as social networks and security measures, and was paid R$3,000 with her own resources. The lawyer questioned the circumstances of the payments.

“If Walter provided services to Carla Zambelli to take care of her social network, why weren’t the payments official? Why didn’t Walter have an official hire? Is there a contract between Carla Zambelli and Walter? Who made the payments, did they leave Carla Zambelli’s account? People need to explain why, it makes no sense for money to leave an assistant, ”she questioned.

According to investigations, Delgatti would have received resources from former advisors Jean Vilela and Renan Goulart in bank transfers via PIX in October last year.

Prison even with collaboration

Still according to lawyer Ariovaldo Moreira, Walter Delgatti reported that he “fears for his life”, and that he is trying to get a place in a secure wing of the prison system. He was taken to the Provisional Detention Center in Araraquara (SP), where he is awaiting the custody hearing to be held later this afternoon.

The defense will also try an appeal to get him released from prison with the allegation that he confessed and contributed to the progress of the investigation. According to Moreira, preventive detention so that Delgatti no longer has access to the CNJ systems is not justified.

“Absurd, the decision of Minister Alexandre de Moraes is somewhat abusive. Took me by surprise. I did not expect that Walter would be arrested preventively due to this crime that they are attributing to him”, he said.

The lawyer believes that, if Delgatti is convicted of invading the system, he may have a sentence of three to five years in prison attenuated to a semi-open regime for having contributed to the investigation.
