Group created by the PGR allocated BRL 2.2 billion against Covid – 05/11/2023 – Panel

The GIAC (Integrated Office for Monitoring the Covid-19 Epidemic) of the Public Prosecutor’s Office allocated around BRL 2.2 billion to combat the coronavirus.

Most of the resources were deposited in court and were sent to face the pandemic after prosecutors and prosecutors of the group identified the amounts and called judges and parties for negotiation.

Giac was created by determination of the PGR (Attorney General of the Republic), Augusto Aras, even before the virus arrived in Brazil.

The objective was to centralize the MP’s activities and provide legal certainty to agreements due to the emergency required by the health situation.

As, for example, emergency purchases were necessary at prices far above the market due to the scarcity of inputs, the initiative prevented managers from being sued in court by various prosecutors.

Representatives of the Ministry of Health, Anvisa (National Health Surveillance Agency), Conass (National Council of Health Secretaries), Conasems (National Council of Municipal Health Secretaries) and other bodies involved in the confrontation were also part of and provided participants of technical and strategic information.

Deputy prosecutor Célia Regina Delgado, who coordinated the group, cites the lack of oxygen crisis in the Amazon as an example. According to her, the company White Martins was called to the table and suggested an emergency solution: to reduce the purity of the oxygen offered, which would make it possible to double the production capacity.

“But then there was the fear: what if someone from the Public Prosecutor’s Office comes and fines the company for not meeting the stipulated requirements? At that time, we contacted Anvisa, which defined new acceptable criteria and from there we arrived at the possible solution. it was mediation”, he says.

Due to the nature of the action, most of the agreements, at least 1967, were signed extrajudicially. Giac also acted in 11,281 legal proceedings. “The judicial system was not built to provide responses at the speed required by this type of action. The crisis brought out the logic of common sense and good faith”, says prosecutor Jairo Bisol, representative of the CNMP (National Council of the Ministry Public) on Giac.

The prosecutor Rafael Meira Luz, highlights the capillarization of the structure. “As we were aware in the states and municipalities, even though there weren’t devices for everyone, respirators, for example, when they were available, we managed to make a more equitable distribution”, he recalls.

Despite the end of the health emergency declared by the WHO (World Health Organization) last week, the Giac continues to exist. It remains on stand-by, ready to be activated if necessary.
