Government should not regulate scams on social networks by MP – 02/09/2023 – Power

The federal government must present a bill against scamming on social networks or make suggestions to the bill of fake news, a draft report by federal deputy Orlando Silva (PC do B-SP) that has been pending in Congress for three years.

After the January 8 attacks, President Lula (PT) asked the Ministry of Justice for a project to curb coup-promoting content on digital platforms. The folder sent the government a suggestion for an MP (provisional measure), a format that was criticized by organized civil society and by deputies due to the sensitivity of the issue.

In addition, an MP could stop at the STF (Federal Supreme Court).

In 2021, former President Jair Bolsonaro (PL) tried to propose rules to social networks by way of a provisional measure, and both Congress and Minister Rosa Weber decided that the issue could not be regulated in this way.

The discussion on the subject is inter-ministerial and the government has not yet reached a consensus on proposing a new project —which, depending on the negotiation, may be attached to the fake news PL—, or making suggestions to the text that is already being discussed in parliament.

Orlando Silva, an ally of the government, met for the first time with representatives of the ministries this Thursday (9) to address the issue. The State Secretariat for Institutional Relations, the Chief of Staff, the Ministry of Justice and Secom (Secretariat for Social Communication) participated.

“Obviously, January 8 is a historic and extremely serious fact that impacts the discussion we were already having”, says the congressman. He expects the topic to generate even more traction for the project for which he is the rapporteur. The text has already been approved in the Senate.

Alexandre Padilha, Minister of Institutional Relations, also signaled this Thursday, in Congress, that the issue will not be addressed by MP.

“The decision that we built within the scope of the government is to take advantage of the production that has already been approved in the Senate and is here in the Chamber”, he said.
