Minister Gilmar Mendes, of the Federal Supreme Court (STF), defined as “almost heroic” the commitment of the Federal Supreme Court in the fight against so-called fake news in recent years. In a public hearing of the Supreme Court on the Civil Rights Framework for the Internet this Tuesday (28), Gilmar praised the Court in front of members of the government, representatives of social networks and heads of associations in the communication sector.

“We’ve had a continuous clash over all these years in this universe inappropriately called ‘fake news'”, said the magistrate. “We’ve dealt with this theme almost heroically in this context, but we need to improve the toolkit,” he added. The minister expressed the desire for a legislative solution to combat fake news. For him, it is “urgent that we find solutions to this problem both from the judicial perspective, submitted to the Federal Supreme Court, and from the legislative perspective, which has been widely discussed in a responsible manner within the scope of the National Congress”.

The focus of discussions at the public hearing is article 19 of the Marco Civil da Internet, which talks about the accountability of platforms for illicit content published by their users. The Brazilian State and social networks are fighting to define a change in this provision of the law.
