Gilmar Mendes says that award-winning delation was a wrong creation of the PT

Minister Gilmar Mendes, of the Federal Supreme Court (STF), criticized the performance of the Operation Lava Jato task force and said that the institution of the so-called “prize-winning” was a mistaken creation of the government of former President Dilma Rousseff (PT) with a text “without parameters”, which would have been written by the then federal judge Sérgio Moro and the attorney Deltan Dallagnol, today federal deputy for Podemos-PR (see in full).
Mendes’ statements were given during his participation in the program Roda Viva, on TV Cultura, on Monday night (8). In the same interview, the magistrate made other criticisms of Lava Jato and said that “Curitiba has the germ of fascism”, in reference to the base of the investigations of the operation.
In response to the minister’s statements, federal deputy Deltan Dallagnol (Podemos-PR) said that Mendes “never respected the liturgy of office, prohibitions in the judiciary law, rules of suspicion, distance from defendants, nor did he understand the role of fighting corruption to the preservation of democracy”.
The award-winning collaboration, provided for in Law 12.850/2013, is an agreement made between the defendant, or investigated, and the investigation bodies. According to the Public Prosecutor (MPF), Thaméa Danelon, the whistleblower, in addition to confessing his crimes, must indicate other people who are involved, provide evidence of his allegations and compensate the victim.
When criticizing the device, Mendes said that the terms of the law gave rise to questions. “Fighting corruption has to be done within the framework of legality, and then I think there was a mistake by the PT government, by the [ex-] President Dilma, by creating the accusation without any parameter, and they understood that they were fighting corruption. When, in fact, this text was certainly written by Moro, even due to the bad writing it must have been by Moro, Dallagnol, and things like that, ”he said.
While Gilmar responded to the interviewers, Moro posted a message on twitter stating that he does not have the “obsession” that the magistrate has for him, and that he fought corruption and arrested criminals.
“I don’t have the same obsession with Gilmar Mendes that he has with me. I fought corruption and arrested criminals who plundered democracy. Not many can say the same in this country,” he said.
Finally, Gilmar Mendes said that the institution of the award-winning collaboration generated the “anti-political discourse” and that “Lava Jato makes Bolsonaro its candidate”.
Deltan counters Gilmar Mendes
In a post made this Tuesday morning (9), Dallagnol countered the statements by the STF minister. He said Mendes “never respected the liturgy of office” and “didn’t even understand the role of combating corruption in preserving democracy.”
“While looking for flaws in Lava Jato, the minister tries to strain needles, but swallows camels, systematically voting in favor of the acquittal and annulment of corrupt sentences, against the technical votes of ministers like Edson Fachin”, he wrote.
The deputy still provoked the magistrate: “There are many questions that Minister Gilmar needs to answer: have you already called newsrooms asking for the heads of journalists? Have you called universities asking for the heads of academics whose work you disliked? Have you called politicians to ask indications? Did you call ministers from other courts to influence votes?”.
