Gilmar Mendes orders Monique Medeiros to return to prison

The Minister of the Federal Supreme Court (STF) Gilmar Mendes ordered this Wednesday (5) the arrest of teacher Monique Medeiros, accused of participating in the death of her own son, four-year-old Henry Borel.

The decision was motivated by an appeal filed by Leniel Borel, the boy’s father, to overturn the decision of the Superior Court of Justice (STJ) that determined the release of the accused. Mendes accepted the opinion of the Attorney General’s Office (PGR) and determined that Monique should return to prison, informed Agência Brasil.

“The contested decision [do STJ] not only is it divorced from the reality of the file, but it also affronts the peaceful jurisprudence of this court, justifying the acceptance of the appeal claim “, argued the minister. Gilmar Mendes also demanded the completion of the judgment that could condemn the teacher.

“Nothing justifies that a crime of this nature remains, until today, without a definitive solution within the scope of Criminal Justice, projecting a serious sense of insecurity among the members of the community”, he concluded. With the decision, the Supreme will communicate the Justice of Rio de Janeiro about the decision. Then the arrest must be made.

Monique is accused, along with her then-boyfriend, former councilor Jairo Souza Santos Júnior, Dr. Jairinho, of having participated in the death of his son, Henry Borel, four years old, on March 8, 2021, in Rio de Janeiro. The boy was taken to the hospital, but already lifeless.

The suspect is that the child was assaulted by Jairinho. The former councilor and Monique deny that there was any aggression against Henry. In both versions, the boy was injured when he fell from the bed where he was sleeping. The date of the judgment by the Jury Court will still be set by Justice.
