The Minister of the Federal Supreme Court (STF) Gilmar Mendes annulled this Thursday (16) decisions of the Rio Court of Justice that cleared councilor Carlos Bolsonaro of a criminal complaint for defamation made by Psol. The minister determined that the TJ-RJ review the accusation again, reported the newspaper O Globo.

The action was filed due to a publication made by Carlos in which he related former federal deputy Jean Wyllys to Adélio Bispo, who stabbed Jair Bolsonaro in 2018. In the post, a witness allegedly stated in a statement to the Federal Police that Adélio was in Wyllys’ office, information that has never been substantiated.

The minister considered that essential points of the process were not addressed during the trial that rejected Psol’s accusation. “It remains clear that there is a certain and determined event in time, and it is possible to infer that, in principle, the defendant’s manifestation would have extrapolated mere criticism, and could characterize a crime of defamation”, wrote Gilmar Mendes.
