Front proposes suspension of CARF judgments – 7/1/2023 – Panel

The FPE (Parliamentary Front for Entrepreneurship), which brings together 184 deputies and 35 senators, wants to annul the CARF judgments carried out during the term of the MP (Provisional Measure) that ended the casting vote. According to the accounts at the front, the lawsuits filed in the period add up to R$ 30 billion in litigation.
The interim president of the FPE, deputy Joaquim Passarinho (PL-PA), presented an amendment to the bill that the Luiz Inácio Lula da Silva (PT) government had to present when it failed to prevent the MP from lapse.
In the justification, the parliamentarian explains that the casting vote was extinguished three years ago by the parliamentarians and that only taxpayers whose processes have been guided “in the short months of validity” of the text will be submitted to “ephemeral rules established by the MP, not endorsed by the National Congress”.
The end of the casting vote is one of the pillars of the Minister of Finance, Fernando Haddad (PT), to increase the collection of public coffers. Today, as a rule, when there is a tie in CARF judgments, the decision that prevails is always in favor of the taxpayer.
The loss of validity of the MP was one of the signs given by Congress of the lack of organization of the government’s support base.
At the Planalto Palace, however, there were those who made light of the defeat, arguing that the collected in the period would already be enough to give a breath to the public accounts. In this case, the measure could be edited again every year, guaranteeing an increase during the four months of validity.
