The recent meetings at the universities of Pisa and Siena, in Tuscany, to discuss the Constitution and the role of judges and prosecutors in the democratic crisis may confuse citizens.

CNMP counselor, judge Daniel Carnio was an inspiration for the events.

He obtained authorization from the PGR Augusto Aras to participate in a “high training course in constitutional justice” at the University of Pisa. Tickets were issued (R$ 38.7 thousand) for departure on 1/13 and return on 1/23 (R$ 25.2 thousand in daily rates).

The forum in Pisa took place on 1/16. Carnio was one of the speakers. He and TRF-1 judge Hugo Abas Frazão, a doctoral candidate at that university, organized the meeting.

The CNMP reported that “during the five working days that he was in Italy, the councilor did not leave his office duties”.

The debate in Siena took place on 1/24. It was an improvised academic program, in a room with eight people. The online broadcast recorded 14,900 subscribers. There were many compliments.

Judge Antonio Souza Prudente, from TRF-1, and judge Frazão, two exhibitors, had been in Italy for days, as they participated in the event in Pisa. Frazão suggested that meeting in Siena.

“Hugo encouraged us to address the issue,” said Professor Tania Groppi of the University of Siena. He was “the engine” of this event, said Nelson Ribeiro, president of Ajufe. The organization paid part of the membership fee.

Daniel Carnio is a titular judge of the 1st Court of Bankruptcy and Judicial Recovery of SP. He was academic coordinator of Ibajud (Brazilian Institute of Judicial Administration), lobbying law firms, judicial auctioneers, cattle ranchers, agribusiness companies, court administrators and credit recovery firms.

The institute formed new judicial administrators, who replaced the former liquidators of bankrupt estates. Judges saw the risk of market reserving and influence peddling. Certificates from Ibajud, a private institution, would facilitate the appointment of judicial administrators.

“Ibajud does not offer any lobbying returns to its sponsors,” said lawyer Rosely Cruz, founder of the institute, in 2018.

In 2017, Ibajud took STF Minister Alexandre de Moraes to give lectures on judicial recovery in California (USA).

The Forum Ibajud Algarve 2022, in Portugal, ended with dinner and a show at a casino. During an event in Porto, Carnio launched the book (co-authored) “Comments on the Corporate Recovery and Bankruptcy Law”.

Carnio has a good image among businessmen. In 2018, he was elected jurist of the year by the Order of Economists of Brazil. He participated in drafting the reform of the Bankruptcy and Judicial Reorganizations Law.

In the judiciary, his long stay outside the judicial activity is criticized.

Holder of the 1st Court of Bankruptcy and Judicial Reorganizations of SP, Carnio was an auxiliary judge of the Corregedoria Nacional de Justiça and assistant to the presidency of the STJ, which nominated him for the vacancy in the CNMP.

Carnio is also criticized for traveling a lot. On the 30th, he will visit the Inter-American Court of Human Rights, in San Jose, Costa Rica.

In 2022, he went to several events abroad. Participated in the seminar “post-pandemic law“, at the University of Valladolid, Spain.

He was elected chairman of the Judiciary Committee of the “International Insolvency Institute“, in Canada. He attended a course in Italy on protecting criminal victims. He gave a lecture at the Senate, in Rome, on the Covid-19 pandemic.

In Paris, he participated in the “1st Meeting of Droit des Affaires“. He ended the year in Argentina, talking about “Globalization, Economic Crisis and Business Insolvency“.
