FGTS will distribute BRL 12 billion to workers – 07/12/2023 – Market

The Board of Trustees of the FGTS (Fund for the Guarantee of Length of Service) should distribute R$ 12 billion to quota workers this year. The amount refers to the profit for 2022, which fell 3.7% compared to the previous year.

Money needs to be deposited by the end of August in all FGTS accounts that had a balance on December 31, 2022. The amount passed on to each worker varies according to the amount he had in the fund at the end of last year.

The collegiate will decide on the distribution this month. The available options are for a transfer of at least R$12.7 billion (equivalent to 99% of the profit obtained) or a slightly higher amount, of R$12.8 billion.

The decision will be taken on July 25, when the board meets.

The money, however, does not easily reach the worker’s pocket, as it can only be withdrawn in situations such as unfair dismissal, retirement and home ownership.

The FGTS began distributing its results to shareholders in 2017, during the Michel Temer government. At the time, a percentage of 50% of profit was fixed.

In 2019, the government even raised the distribution to 100% – but then went back. The decision also removed from the law the obligation that the transfer be of 50%, generically determining that “part of the positive result earned” will be released.

The FGTS had BRL 49.8 billion in revenues in 2022 and expenses of BRL 36.9 billion. In comparison with what had been estimated in a provisional balance sheet, expenses increased by R$ 2.3 billion.

The difference is due to the item Equity Income and Loans, which are equivalent to resource reserves to cover defaults.

Last year, the FGTS distributed BRL 13.2 billion to those with an account in the fund, which led to a return of 5.83% per year for workers.

The FGTS remuneration defined by law is 3% per year, plus the TR (Referential Rate). The value is supplemented by the distribution of the fund’s profits.

This supplementation of income from FGTS accounts with the fund’s profit is the government’s main argument in the STF (Federal Supreme Court) judgment on the fund’s profitability.

Who is entitled to the FGTS profit?

All accounts linked to the FGTS, whether active or inactive, are entitled to receive the previous year’s profit. Payment is made by August 31 of each year, for those who had a balance on December 31 of the base year. Profit appears separately on each of the worker’s accounts.

How is the payment done?

Distribution is carried out by Caixa, which manages the fund. The amounts are credited and, in the FGTS statement, the information “AC CRED DIST RESULTADO ANO BASE 12/XXXX (here will be informed the year to which the payment refers)” appears.

When to withdraw the amounts?

The worker will only be able to use this money if he fits into one of the withdrawal situations provided for in Law 8.036/90 for the withdrawal of the FGTS, such as dismissal without just cause, retirement, purchase of a home and serious illness, for example. How to consult the FGTS statement?

The value can be consulted in the FGTS application, through the fund statement. It is also possible to obtain a copy of the statement at Caixa branches. For each company where the worker was hired, there is an open linked account, it is necessary to observe the value in each account and add up how much there is, in all.
