Federal District – The assets of more than 40 arrested for coup acts on January 8 were blocked by the Federal Court of the Federal District. It is estimated, at the moment, that the damage caused a loss of R$ 18.5 million.

The decision was obtained within the scope of the second precautionary action filed by the Advocacy-General of the Union (AGU) in order to ensure reimbursement to the public coffers, in the event of a subsequent final conviction of those involved.

With the 40 names now included in actions, a total of 92 people and seven companies have their assets blocked for financing or participating in anti-democratic acts. The third precautionary request for the blocking of assets, filed by the AGU on Friday (27/1), covers another 42 prisoners in flagrante delicto and is still awaiting analysis by the Justice.

In the decision, federal judge Francisco Alexandre Ribeiro noted that the Union attached copies of the arrest records to the case and recognized that there are “strong indications, therefore, that the said defendants participated in the anti-democratic acts and demonstrations that culminated in the invasion and depredation multitude of the official headquarters of the Three Powers of the Republic, which is why the thesis of the Union that they contributed to the achievement of the massive damage to public property is absolutely plausible, being subject, therefore, to a lot of civil liability”.

On January 19, the AGU increased from BRL 6.5 million to BRL 18.5 million the request for blocking the assets of companies and participants in the acts. In this first action, 52 people and seven companies were on the list to be held accountable and charged for damages to the Planalto Palace, the Federal Supreme Court (STF), the Federal Senate and the Federal Chamber.

The second action, which has now been granted, increased the number of extremists who must bear the costs by 40 people. According to the AGU, the two precautionary actions aim to ensure that the assets of the accused can be used to reimburse public assets in the event of a subsequent final conviction.

The total amount that the AGU requests to be blocked in both actions, R$ 18.5 million, takes into account reports of damage estimates presented in the three buildings.

The documents are drawn up based on information from the Civil Police of the Federal District (PCDF) and the decision of STF Minister Alexandre de Moraes who decreed the preventive detention of the accused. The AGU points out that they “participated in the materialization of the acts of invasion and depredation of federal public buildings, (…) so much so that, in the midst of these acts, they were arrested in flagrante delicto as responsible for the acts of vandalism in the premises of the buildings of the Three Powers of the Republic and in the face of the same, preventive detention was decreed”.

Also according to the AGU, the accused “participated actively in unlawful acts which, more than the material damage to the federal public property object of this action, resulted in damage to the democratic order itself and to the Brazilian image” – which is why they must repair the damage. caused in solidarity, under the terms of the Civil Code.
