Minister Edson Fachin, of the Federal Supreme Court (STF), voted in favor of making defendants over 250 denounced by the Attorney General’s Office (PGR) for alleged participation in the acts of January 8, in Brasília, this Monday morning (15 ). With this, the Court forms a majority for the fourth block of actions in the virtual plenary, with the votes also of Alexandre de Moraes (rapporteur), Dias Toffoli, Rosa Weber, Cármen Lúcia and Gilmar Mendes.

The five ministers accompanied Moraes in voting in favor of making defendants accused by the PGR. Only Nunes Marques and André Mendonça voted against the inquiry that investigates the alleged instigators of the acts and followed with reservations the action on the execution suspects.

As a result, those cited in inquiry 4921 become defendants for the crimes of incitement to crime and criminal association, while those covered by 4922 were charged with the crimes of criminal association, violent abolition of the Democratic State of Law, coup d’état, damage and damage qualified with violence to the person or serious threat and use of flammable substance against the property of the Union, in addition to destroying, rendering useless or deteriorating property specially protected by law.

With the score at 6 to 2, the STF will have accepted 800 complaints offered by the PGR. The judgment of this fourth block ends at 23:59, with the opening of the fifth group with another 250 people at 00:00.
