Dino demands network regulation and praises the Judiciary – 02/15/2023 – Power

The Minister of Justice, Flávio Dino, said this Wednesday (15th) in São Paulo that the Judiciary was summoned to activism by society. He also defended the regulation of social networks.

The statements were given during an event promoted by the BTG Pactual bank, moderated by former Minister of Defense Nelson Jobim.

“The question is: the Judiciary is an activist because it wants to be or it is an activist because it wants to be or it is an activist because it is invited to do so. More than invited, summoned. Summoned by whom? By society”, he said.

Dino cited two reasons for this: the political crisis and economic litigation.

“It is unfair at this point to attribute to the Judiciary a kind of undue interference in the political and economic game. I would say that the Judiciary was more especially led to this and I can say that the results were more positive than negative”.

The Minister of Justice also defended the regulation of social networks.

“We have to work with new issues, one of which is the internet. We are proposing a serious debate in which there is obviously no restriction on freedom of expression, but there is an understanding that absolute freedom of expression does not exist. who says that is the Penal Code.”

For the minister, in some cases, depending on the gravity, it is necessary to act to avoid more serious damage to society.

Dino stated that the idea is not to regulate matters of opinion or even fake news, but crimes. He joked, citing the example of one thing being said to be obese, but quite another to say that, because he is obese, he deserves to be machine-gunned, decapitated and exposed in a public square.

“Can anyone here think that this is a reasonable speech? Of course not. So, a priori, you have to control. And this control is done by who? By the platforms”, he said. “The issue is that they follow their own criteria for making that arbitration,” she said.

Dino said that the government is working on a project on the subject, targeting international practices, mainly in the European Union.

The minister also cited the case of illegal mining in the Amazon, at the center of the debate due to the consequences of activity on indigenous lands. According to him, the focus has been on financiers and those who launder illegal gold.

“We didn’t arrest 15,000 prospectors because it was impossible to arrest 15,000 prospectors. That’s it,” he said. “We cannot leave an inefficient criminal law for a terrorist criminal law and a criminal law that sees prison as the answer to all illegalities. This serves to elect people, but it does not serve to fight crime.”
