The Minister of Justice and Public Security, Flávio Dino, defends that representatives of the Three Powers and civil society form part of a new body to supervise social networks.

“So it could be the Executive Power, it could be an agency that has a mixed composition. It’s the model that I like the most. I think it had to be a little bit of the Three Powers and a little bit of civil society without a heavy structure. When I speak As a regulatory agency, I think of a heavy structure that sometimes doesn’t work well, or a council that sets guidelines,” he said.

The minister’s statement took place this Wednesday (19) when asked what would be the best regulation governance system, in an interview given to Jota.

Dino emphasized that the main defenders of democratic regulation must be the same defenders of freedom of expression, when criticizing those who think that the two things do not go together.

“It’s an attempt to place a contradiction either you defend freedom of expression or you defend regulation. No. Anyone who absolutizes freedom of expression is a Pharisee in a biblical sense or is a whitewashed tomb, it’s false. Uses freedom of expression as a shield to destroy it,” he said.

“That’s why we need regulation. What is the maximum area of ​​privacy that we have? Our house. Our house has multiple legal regulations in our living room, in our kitchen, labor laws, the civil code, the statute of Children and Adolescents, in our home.”

“Privacy has a rule, it has regulation. The internet cannot be a more unregulated space than a person’s home in the name of privacy”, he said.

After a failed attempt last year to accelerate a project that regulates the performance of platforms in the country, Congress is working on the last details of a text that should be voted on by the end of the month, amid pressure on social networks motivated by recent attacks. to schools.

The text’s rapporteur, Deputy Orlando Silva (PC do B-SP), finalized this Monday (17) a draft of the substitute, incorporating some suggestions from the government. Now, he begins to rotate the benches of deputies to negotiate adjustments to the proposal that will be voted on in plenary.

According to the mayor, Arthur Lira (PP-AL), the expectation is that the project, dubbed the Fake News PL, will be voted on the 26th and 27th of this month.

The discussion on the creation of a body to supervise and fine social networks —and on what it would look like— is one of the challenging points in the regulation of platforms, a topic addressed in the Fake News PL.

The substitute states that the “Executive may establish an autonomous supervisory entity” and that it “must have guarantees of administrative autonomy and independence in the decision-making process”, in addition to having formal spaces for multisectoral participation.

Among the tasks of the entity would be the inspection, the application of sanctions and the regulation of points of the law.

Even if a consensus is reached on assigning oversight to a body outside the Judiciary, the format and composition of the entity should be the subject of debate. A first point should be to decide whether the task would fall to a new body or an existing structure.
