Judge João Lages, from the Regional Electoral Court of Amapá (TRE-AP), summoned elected state deputy Zeneide da Silva Costa, his brother João da Silva Costa, known as Dudão, mayor of Mazagão, and eight other people so that, in the within five days, present a defense, being able to gather documents and enlist witnesses, in the Electoral Judicial Investigation Action (AIJE) filed by Giodilson Pinheiro Borges (former mayor of Mazagão) and Max Ney Machado Andrade (Max of AABB), state deputy re-elected.

Giodilson and Max from AABB maintain that Dudão Costa, as mayor of Mazagão, carried out simulation of bidding procedures and the consequent contracting and payment of large amounts to companies linked to relatives of municipal servants, with the purpose of feeding the “Caixa 2” used for the benefit of Zeneide Costa, elected as a state deputy.
The authors of the AIJE asked for the granting of precautionary measures such as the breaking of bank, telephone and telematic secrecy of all those investigated, as well as the contracted companies; the decision to open a police investigation by the Federal Police; the suspension of diplomacy of the investigated Zeneide Costa (already carried out) until the final decision of the process; and the removal of João Costa from the position of mayor of the municipality of Mazagão for a period of 180 days. Requests were denied.
According to Judge João Lages, rapporteur for the action, although the allegations describe a potential scenario of serious threat of injury to municipal public coffers, which, as reported by the authors, is the subject of investigation in public civil action records handled by the Public Ministry local, he did not see, at least in the initial demonstration, that the values used to contract services by the Mazagão city hall were diverted to feed Zeneide’s electoral campaign.
