Deputies try to preserve civic-military schools in RS – 07/18/2023 – Panel

Five Republican state deputies in Rio Grande do Sul filed a bill this Monday (17) to try to prevent the extinction of 25 civic-military schools in the state.

However, the CPERS-Sindicato, which represents teachers in the state network, argues that the model has been operating illegally since June 30, when there was a decision by the Rio Grande do Sul Court against the format, in response to a public civil action.

The issue came up again last week in view of the Lula government’s determination to extinguish the model, reinserting schools into the conventional public network. Governor Eduardo Leite (PSDB), however, expressed his intention to maintain the existing civic-military schools in RS. The subject was the subject of a chat between Leite and former deputy Jean Wyllys on social networks.

RS has 43 schools with this format – of these, 25 have support from the Armed Forces and 18 were conceived in a gaucho model analogous to the federal one, but with retired military police as monitors. The bill foresees the incorporation of these 25 schools by the Government of RS.

Since November 2022, an injunction obtained from a public civil action filed by CPERS prevents new schools in RS from adhering to the model.

This Tuesday (18), the judges of the 25th Civil Chamber of RS will once again focus on the subject. But, for the CPERS lawyer, Rogério Coelho, the object has been impaired since June 30, when the Court of Justice decided in the first instance that the format was illegal, for violating the Constitution of RS and the Law of Guidelines and Bases of Education.

The sentence, by the judge of the 7th Public Treasury Court of Porto Alegre, Murilo Magalhães Castro Filho, declares “the illegality of the application of Decree 10.004/2019 to state schools, and that model should not be applied in state schools”. According to the sentence, the format violates the principle of autonomy in school administrative management.

“The sentence does not provide for any suspensive effect, so it has been valid since it was handed down. The Government of RS can appeal the decision, but until then these schools are illegal”, says the lawyer.

For Neiva Lazzarotto, director of the CPERS nucleus that filed the public civil action against the schools, the format beckons to needy schools with the promise of resources and violates the democratic management of public education.

“The civic-military school aims to recruit supporters of extreme right-wing ideology. It is an indoctrination tool. What they say they fight so much,” he declares.

Asked about the understanding that schools are operating illegally, the State Department of Education said that the matter is under the competence of the PGE (State Attorney General). The PGE understands that the decision does not have immediate effect and says it is preparing the appropriate appeal.
