Deltan’s testimony in STF investigation is postponed – 06/02/2023 – Power

Federal deputy Deltan Dallagnol (Podemos-PR) reported that the statement he would give to the Federal Police this Friday afternoon (2nd) was rescheduled for Monday (5th).

According to a note released by Deltan’s advisory, the parliamentarian’s lawyer only had access to the records “instantly before the hearing” and, therefore, the interrogation was postponed.

The deputy also informed that he is the target of an investigation that is being processed by the STF (Supreme Federal Court) due to an interview given about the judgment of the TSE (Superior Electoral Court) that led to the annulment of his mandate. The rapporteur is Minister Alexandre de Moraes, who chairs the electoral court.

According to a spokesperson, Deltan was summoned to “testify as investigated about an interview he did as a parliamentarian, regarding facts related to his activity, exercising his right and protected by his immunity over opinions and words”.

In an interview with Sheetthe deputy said that the seven ministers of the TSE (Superior Electoral Court) agreed behind the scenes on the decision to withdraw his mandate even before the issue was judged by the court’s plenary.

He directed the harshest criticisms at the rapporteur of the process, Minister Benedito Gonçalves. “The leading minister of the vote brought a vote that aims to hand over my head in exchange for the prospect of strengthening his candidacy for the Supreme Court,” he said.

According to the congressman, the other six members of the electoral court were influenced by the Lula government.

Still according to Deltan’s advisory, “it was not informed which criminal rule would have been violated” by the parliamentarian.

“Since the deputy only had access to the reason for the investigation at the time of the deposition, and his lawyer only had access to the file moments before the hearing, this was rescheduled for Monday. The deputy asked his lawyer to ask the STF to secrecy about the feat is lifted, in prestige to the publicity of public acts and appreciation of transparency”, says the note.

On the last 16th, the TSE unanimously revoked the candidacy registration and, consequently, the deputy mandate of the former coordinator of the Lava Jato Operation task force in Curitiba.

The action stems from the representation of the Brazilian Federation of Hope (PT, PC do B and PV) and the PMN, who claimed that Deltan could not have left his career as a public prosecutor to enter politics because he responded to disciplinary complaints, inquiry and request of measures with the CNMP —which supervises the functional duties of the members of the Public Prosecutor’s Office.

The opponents of the former prosecutor stated that the case fits into one of the ineligibility provisions defined with the 2010 edition of the Clean Record Law.

Last Tuesday (30), Deltan presented his defense to the Corregedoria of the Chamber of Deputies to try to reverse the impeachment of his mandate.

One of the main arguments put forward by the parliamentarian is that 12 of the 15 procedures being processed against him at the CNMP at the time of his dismissal were based on “illicit evidence”.
