Delegate asked to secrecy of PCC case, says Justice – 03/24/2023 – Power

The Federal Justice of Paraná said this Friday (24) that the request to remove the secrecy of the investigation into the plan of the criminal faction PCC against authorities came from the Federal Police delegate responsible for the case.

In a note, she informed that, upon receiving the request, Judge Gabriela Hardt, from the 9th Federal Court of Curitiba, did not agree with the full breach, identifying that full publicity could bring risks to the victims and those investigated in the case, and determined that if you maintained partial, level 1 secrecy.

In practice, this allowed the press to have access, for example, to documents such as decisions that authorized arrests and searches.

The judge withdrew secrecy of part of the process shortly after statements by President Luiz Inácio Lula da Silva (PT) suggesting a possible “framing” of former judge Sergio Moro in the case.

The Federal Justice reported that the delegate’s request was made at 2 pm on Thursday (23), but did not make the content of the request available.

The name of the delegate who made the request for the breach of secrecy was also not informed, but the requests for preventive detention, on the last 13th, were signed by the delegate Martin Bottaro Purper.

The report sought the PF this Friday, but has not yet received a response.

“The removal of the secrecy of the process was a request from the delegate who conducts the investigations, filed in the records at 2 pm yesterday (March 23). secrecy 1, for the safety of the investigated and victims, authorizing the disclosure only of the police representations and the decisions that authorized the arrests and searches, as well as the custody hearing term”, reads the full note.

This Friday (24), the chief minister of the Social Communication Secretariat of the Presidency of the Republic, Paulo Pimenta (PT), criticized the judge on a social network, suggesting that there would be no request from the PF to withdraw the secrecy.

“A judge withdrawing the secrecy of a sensitive and dangerous inquiry that is still ongoing, without agreeing with the PF who is in charge of the investigation, helps with what? All this to help a friend’s narrative? Do you think it’s normal? They don’t get angry ?” he wrote.

“I believe that this is an important investigation, which involves a dangerous criminal organization that planned attacks against authorities and cannot be ‘captured’ by anyone’s personal interests. Federal Police, MP and Judiciary are State institutions. Gabriela Hardt ends up exposing the investigations and, consequently, disturbing them, since the investigations are ongoing and deal with a sensitive issue, which is that of criminal organizations. Was your objective to help the PF?”, continued Pimenta.

On Thursday, Lula suggested, without evidence, a possible “framing” by Moro, who would be one of the PCC’s targets, according to PF investigations.

“I’m not going to talk because I think it’s another set up by Moro. I want to be cautious, I’m going to find out what happened. It’s visible that it’s a set up by Moro”, said the president. The conclusion intensified the dispute with opponents, amid the disclosure of more details of the police investigation. Moro reacted by demanding “decency” from the president.

The material made public by judge Gabriela Hardt shows that the PF, in the arrest warrant sent to the court, stated that the PCC’s plan of attack was imminent and that the faction monitored places where Sergio Moro frequented. One of the addresses was the club in Curitiba where Moro voted in the 2022 election.

The information was used as a basis for Operation Sequaz, launched by the PF on Wednesday (22). 11 arrest warrants and a series of diligences were carried out.

The investigators began their investigation based on the testimony of a former member of the PCC who became a protected witness of the Justice of São Paulo.

He was the one who reported Sergio Moro’s kidnapping plan, which was later taken to Federal Police investigators.
