Defense of colonel arrested by 8/1 asks that he be spared from going to CPMI

The defense of Colonel Jorge Eduardo Naime, former commander of Operations of the Military Police of the Federal District (PMDF), asked this Friday (23) the Federal Supreme Court (STF) that he be spared from testifying as a witness to the Mixed Parliamentary Commission of Inquiry (CPMI) of January 8. The information is from CNN.
“Following the current understanding of the Court, the patient cannot be coercively led to the testimony, nor punished for non-appearance or, in his judgment, withdrawing from the CPMI”, stated the defense in a habeas corpus request.
Naime has been in prison since February, accused of failing to act during the 8/1 attacks. He was called to give testimony at the CPMI this Monday (26), at 2 pm. If the Supreme Court does not accept his defense request, he would appear with a police escort and speak as a witness.
The colonel’s lawyers also ask that, if he appears before Congress, he has the right to remain silent whenever he wants.
“The unequivocal condition in which Naime will be heard at the CPMI is due to the patient’s right to silence during the session, backed by the constitutional guarantee of non-self-incrimination”, say the lawyers, according to CNN.
