Lawyers for Anderson Torres requested the replacement of preventive detention for the use of electronic anklets

Lawyers for the former Minister and former Secretary of Public Security for the Federal District Anderson Torres asked for the revocation and replacement of the arrest by precautionary measures such as the use of an electronic anklet.

The request was sent to the Minister of the Federal Supreme Court (STF) Alexandre de Moraes, this Monday (6/2).

Anderson Torres was arrested as part of an investigation into the alleged omission or connivance of authorities in the invasion and depredation of the National Congress, the Planalto Palace and the STF, on January 8.

Anderson Torres was named Secretary of Public Safety on January 2, but traveled to the United States on the 7th, although his vacation was officially scheduled for two days later. Anderson Torres was dismissed on the 8th, in the midst of anti-democratic acts at the headquarters of the Three Powers.

Moraes ordered the arrest of Anderson Torres on January 8. He was in the United States and was only detained when he returned to Brazil, on the 14th. During a search and seizure at the former minister’s house, the Federal Police found the “draft of the coup”.

Lawyers told Moraes that the arrest represents an illegal embarrassment. According to the defense, “even in the very short four-day stay of Anderson Torres at the SSP/DF, all care was anticipated, with tasks distributed, relationships established between the participants”.

The defense of the former secretary also said that Anderson Torres is “a servant, who has more than 22 years of intense and unblemished public life as a Federal Police delegate, Secretary of Public Security (DF), Minister of Justice and Public Security of Brazil and, again, Secretary of Public Security (DF)”.

According to the lawyers, Anderson Torres has “absolute interest in elucidating the facts investigated in the present investigation, committing himself, for that purpose, to hand over his passport to the Justice and, from the outset, opening up his secrecy (banking, tax, telephone , telematics, etc.), without prejudice to any and all efforts to clarify all the facts related to the present investigation”. The defense listed 71 points that they consider justifiable for the freedom of Anderson Torres; among them, that there is no relationship between the anti-democratic acts and the former secretary’s family trip.

According to the lawyers, “the maturing of the investigations revealed that the freedom” of Anderson Torres “does not represent any risk to criminal prosecution, given that, in addition to the complete lack of evidence of authorship, his dismissal from the position of Secretary of Public Security of the Federal District and the course of a reasonable period of time for the collection of evidence demonstrate the unnecessary need for his arrest”.

The request to revoke the arrest of Anderson Torres was presented three days after Moraes authorized the release of the former commander of the Military Police of the Federal District (PMDF), Colonel Fábio Augusto Vieira, also arrested in connection with the investigation into the anti-democratic acts of January 8.
