Defender asks to stay out of the fiscal framework – 03/04/2023 – Panel

In a meeting at the Ministry of Planning last Thursday (30), representatives of the DPU (Defensoria Pública da União) asked to stay out of the rules foreseen in the new fiscal anchor, presented by the Minister of Finance, Fernando Haddad, last week.
The ideal, according to the technicians, would be to create an exception, like what should happen with the nursing floor and Fundeb (Basic Education Maintenance and Development Fund). In their assessment, the new anchor must also take into account the impacts on human rights policies.
As presented, Constitutional Amendment 80/2014 had stipulated a period of eight years for the DPU to be internalized and for all jurisdictional units to have a defender.
The target was not reached. Today it is present in 29% of the municipalities that are the headquarters of judicial sections and subsections and has a staff of 680 defenders for the whole country.
The DPU’s budget is just over R$700 million. For the internalization target to be achieved, it is estimated that it would need to be 300% higher. The value is much lower than that of other judicial bodies, such as the AGU (Attorney General of the Union), which has R$ 4 billion, for example.
During the meeting, the director of the Ministry’s Institutional Coordination Secretariat, Luciano Severo, promised to take the demand to Minister Simone Tebet. It was also agreed to resume the dialogue throughout the budget execution.
