Cuca ceases public demonstrations over rape case

The coach Cuca will no longer publicly comment on the conviction for rape to which he was subjected in Switzerland, at the end of the 1980s. In a note released to the press, lawyer Ana Beatriz Saguas and lawyer Daniel Leon Bialski, responsible for representing the coach, informed that any manifestation about the case will be made only by them. The pronouncement came after a new fact increased even more pressure from the fans who asked for Cuca’s resignation. Willi Egloff, a lawyer who represented the rape victim in Switzerland in 1987, denied the statements made by the Corinthians coach, in an interview with UOL, and said that the girl, then 13 years old, recognized the then Grêmio player as one of her bullies.

The lawyer also validated the news published by the newspaper Der Bund, from Bern, in 1989. The publication pointed out that Cuca’s semen was found on the girl. According to Egloff, the exam was carried out by the Institute of Forensic Medicine at the University of Bern.

In testimonies at the time, the victim reported having been forcibly held by four Grêmio players (Cuca, Eduardo Hamester, Henrique Etges and Fernando Castoldi), who remained in prison for 30 days. Fernando was the first to be released, as his participation in the act was not proven. In 1989, Cuca was sentenced to 15 months in prison and paid US$ 8,000.

The judgment was made in absentia, since he and the other gremistas involved in the case had already returned to Brazil after being released at the end of the instruction phase in the process. The process is under 110-year secrecy, protected by Swiss data protection law.
