Cremesp archives investigation of fake news about Lula’s health – 05/17/2023 – Mônica Bergamo

The Regional Council of Medicine of the state of São Paulo (Cremesp) archived the investigation process that investigated the doctor José Antônio Franchini Ramires for spreading false news about the health of Lula (PT).

The episode took place in November 2022.

According to a report by Forum magazine, the doctor would have sent messages in a WhatsApp group claiming to have received information from a “reliable source” from Hospital Sírio-Libanês reporting that Lula was once again undergoing treatment for cancer.

On the day the lies spread, the president was resting in Bahia. The following day, the PT member went to a birthday dinner for vice-president Geraldo Alckmin.

The texts credited to the cardiologist said that the president-elect would have a “carotid jugular lymph node, with certainty locoregional recurrence. He didn’t want to operate, he didn’t accept a tracheostomy, now… Aggressive stage IV tongue-base carcinoma (Sic)”.

The message also stated that, “previously treated with chemotherapy”, Lula “continued drinking, very hoarse voice, dysphagia, post-radiotherapy edema or relapse for sure”.

After the repercussion of the rumors last year, lawyers from the Prerogativas group sent a representation to the council asking that the body investigate the case.

Cremesp’s decision was given in a session held earlier this month.

In the process, Ramires’ defense argued that “the complaint was not supported by any skillful evidence” and that it cites “only and solely the transcription of a journalistic report that describes the alleged practice reported in the complaint”.

“Now, an investigation cannot be instituted against a doctor, based on mere conjectures about conduct that a third party has imputed to him – in this case the ‘Revista Forum’ website. It is necessary, for the continuation of this procedure, that there are indications of materiality and authorship of the investigated facts”, continued the defense of the doctor, who denies the accusations.

“The complaint lacks minimal evidence linking the petitioner to the commission of any medical infraction.”
