Court rejects cash appeal humiliated by Russomanno – 05/15/2023 – Panel

The São Paulo Court of Justice rejected an appeal filed by supermarket cashier Cleide Bezerra da Cruz, in which she accused federal deputy Celso Russomanno (Republicanos-SP) of humiliating her in front of the cameras in an episode in 2005.
The scene was exploited by the deputy in election campaigns, but also used against him by political opponents.
The images were taken during the program Patrulha da TV, on Rede Record, which had Russomanno as the presenter of a panel on consumer rights, its great electoral flag.
At the time, the deputy appeared by surprise at a market where Cleide worked and demanded that he be able to buy products such as toilet paper and a box of matches per unit, citing the legislation. She refused, and an argument ensued.
At the time, many viewers felt that Russomanno had been disrespectful to the box.
In 2020, the deputy used the images in his electoral propaganda, when he was running for mayor of São Paulo. Opponents like Guilherme Boulos (PSOL) defended the employee
Cleide sued the deputy for moral damages, but lost, and now she was defeated again, having the appeal denied.
In his order, Judge Vito Guglielmi saw no damage to the honor of the box. One of the arguments of the decision was that she herself let her image be used by opponents of Russomanno.
“If the author, a public person, for a particular reason, saw fit to express and publicize her opinion in the way she did, she must also necessarily tolerate the criticism of others arising from her own actions”, wrote the judge.
The decision can still be appealed.
