Court decides whether to reopen lawsuit against sale of refinery – 05/02/2023 – Panel

The TRF-2 (Federal Regional Court of the 2nd Region) will decide this Wednesday (3) whether to accept an appeal from the FNP (National Oil Workers Federation) and resume popular action against the privatization of the Landulpho Alves refinery (Rlam), in Bahia.
The refinery was sold in 2021 to the Mubadala Capital fund, from the United Arab Emirates, for BRL 1.65 billion. The topic was recently discussed again with the revelation that the Saudi Arabian government sent jewelry to former president Jair Bolsonaro (PL) a month before the sale.
The Committee on Transparency, Governance, Inspection and Control and Consumer Protection (CTFC), a body of the Senate, is investigating a possible relationship between the facts.
The FNP says the refinery was sold for half its market value to Mubadala and without a bid.
“This judgment is very important because it may mean the resumption within the judiciary of the discussion on the illegality of the sale of Rlam. jewels’ by then-president Jair Bolsonaro and his wife, at the same time as the sale of Rlam to the Arab fund, with Saudi participation”, says Raquel Sousa, FNP’s lawyer.
She claims that Mubadala may become a defendant in the process, if the action is resumed.
“Today, in addition to Petrobras, we can include the buyer as a defendant, produce proof of all the illegality committed, the vile price at which the refinery was negotiated, the trickery, the favoritism, ask for documents to be shown and, in short, prove what we has always been saying that the sale of the Bahian refinery was harmful to the country”, he completes.
