COB states that CBMA has no power in the Wallace case – 04/19/2023 – Sport

In an official letter sent this Wednesday (19), the Ethics Committee of the COB (Brazilian Olympic Committee) reported not recognizing the authority of the CBMA (Brazilian Chamber of Mediation and Arbitration) in the Wallace case.

The text was sent to Octávio Fragata Martins de Barros, from CBMA; Radamés Latari, president of the CBV (Brazilian Volleyball Confederation); and the athlete. The president of COB, Paulo Wanderley and the AGU (Attorney General of the Union) were copied in the message.

Cruzeiro Sada, Wallace’s club, and the player, appealed to the CBMA to mediate the situation of the opposite of the Brazilian team. A hearing was held this Tuesday (18) to discuss the 90-day suspension imposed by the COB Ethics Commission.

At the end of January, he posted a photo on his Instagram account. He was in a shooting club, with a gun in his hand and opened the application’s question box to answer questions from his followers. One of them questioned whether he would use that revolver to shoot the President of the Republic, Luiz Inácio Lula da Silva (PT). Wallace responded with the opening poll questioning who would do that.

The punishment of the Brazilian national team player became a controversy between the COB Ethics Council and the STJD (Superior Court of Sports Justice) of volleyball.

The Committee body suspended him from any Olympic sporting activity in the country for three months. The STJD issued an injunction releasing him to play until the judgment on the merits. This Wednesday, Sada Cruzeiro faces São José in the men’s Superliga semifinal, at 21:00.

The COB warned that the STJD does not override its Ethics Council and signals CBV with punishments if Wallace does not comply with the suspension. The Confederation sent the case to the CBMA.

In the letter, the Ethics Council informs that there is no longer any relationship between the COB and the Arbitration Chamber. Thus, there is no “obedience to the private decisions issued by any of the parties and, therefore, the total alienation of the CBMA from the decision-making process of sports issues linked to the COB.”

For the COB Council, any decision taken by the Arbitration Chamber is a “legal nothing”. Questions like this would have to be taken to the Arbitration Court, a body that hasn’t even been created yet. The administrative act that gave CBMA the power to exercise this function was revoked by the Committee.

“In this way, for COB and its institutional powers, the decision to be fulfilled is that of the Entity’s Ethics Council, and any attitude to the contrary will result in severe sanctions to CBV, the club and the athlete himself”, says the official letter. , making it clear that the risk to the Confederation continues to exist.

The craft, to which Sheet had access, ends up regretting that Wallace, his club and the CBV do not want to comply with the suspension.

“It is regrettable that at a time of national security crisis, when violence affects schools, children and adolescents, and everyone is prevented from going to class due to the risk of armed attacks, criminally planned for these days, the CBV, the athlete and sports club to flatly refuse to comply with ethical sanctions and, across the board, normalize the conduct of posting firearms on social networks, opening comments about who would shoot a large caliber weapon in the face of the highest authority of the republic (… ) The attitude, evidently incompatible with the values ​​of Olympism and sport – corroborated by the CBV, by the athlete and by the club is regrettable, and only dulls the image of those who carry it out and denies the governing values ​​of the sport!”

The AGU also sent a response to the CBMA emphasizing that the body is incompetent to decide anything about the case.

Despite the discussion, the CBMA asks that an administration fee be paid for the matter to be mediated. The amount would be BRL 18,000, but because of the “complexity that the case gained”, he decided to increase the amount to BRL 40,000 to be paid by Wallace.

A Sheet contacted the CBV, but received no response. CBMA says it does not comment on the matter.
