An Italian regulatory body stated this Monday (29) that ChatGPT, created by OpenAI, and the techniques used to collect user data violate the country’s privacy laws.

According to the entity, the discovery was made in an investigation opened by it in March last year and the company that created the chatbot has already been notified.

In its statement, the Italian body said that “the acquired elements may indicate one or more violations of EU regulations.” OpenAI has 30 days to respond to the discovery.

ChatGPT is a chatbot that powers generative intelligence with models that produce human-like text, images, and code in seconds.

OpenAI, based in San Francisco, is backed by Microsoft, which, along with Alphabet’s Google, has used artificial intelligence to improve its products.

At the opening of the investigation in March, the Italian body cited the lack of legal basis to justify the grouping and storage of user data to train the algorithms. A temporary suspension of data collection was requested.

At the time, the body reported that OpenAI could be fined up to 20 million euros (around R$106.3 million) or up to 4% of its annual revenue.
