Minister Alexandre de Moraes, of the Federal Supreme Court (STF), said this Thursday (9), during the Court session, that the charges against each of the prisoners for the acts of vandalism on January 8 will be individualized. According to the minister, custody hearings were held, the provisional freedoms were analyzed and subpoenas were sent for the prior defense of the accused. The minister’s statement was given as a result of criticism of the STF over the alleged analysis of conduct in general in investigations.

“The STF is analyzing it in detail and individually so that, quickly, those who committed a crime are held accountable under the terms of the law. Those who committed a lesser crime will have a lighter sanction, those who committed a more serious crime will have a more serious sanction,” he said.

According to the minister, the volume of work has “overloaded” the Supreme Court, but the Court has managed to meet the legal deadlines “without any disturbance and with absolute peace of mind”.

Moraes says that prisoners do not want to be transferred to their states

For the minister, the STF complied with all the procedures provided for by law in the treatment of prisoners. He reported the visit made to the women’s prison, last Monday (6), accompanied by Minister Rosa Weber, and the acting governor of the Federal District, Celina Leão.

According to him, the detainees do not want to be transferred to their states, as some parliamentarians reported. “I asked all the prisoners this question and there was a unanimous response. There was no disagreement, they all want to stay here, ”he said.

The minister also reported that some lawyers who had been hired by the arrested suspects stopped taking care of the defense of those involved. “They just did the custody hearing and didn’t come back,” he said. Moraes also reported that some of the prisoners refused to accept the role of public defenders in their cases.

At the Court session, Moraes made an assessment of the progress of the investigations. According to the minister, among the 1,400 people arrested after the acts of vandalism, 520 men and 82 women are still being held. The others are free and comply with precautionary measures, such as electronic anklet monitoring.

According to the minister, 919 complaints were made by the Attorney General’s Office (PGR) against those investigated. Of the total, 700 complaints involve the conduct of incitement to crime, incitement of animosity by the Armed Forces against democratic institutions and criminal association, and 219 are about crimes of qualified damage, abolition of the Democratic State of Law and coup d’état.
