Chamber wants agreement with Senate to vote PL for Fake News – 05/15/2023 – Power

Rapporteur of the Fake News PL, deputy Orlando Silva (PC do B-SP) said this Monday (15) that the project must be agreed with the Senate before being voted on in the plenary of the Chamber and defended a mixed system of self-regulation and external regulation of internet platforms.

The text originates in the Senate and is processed in the Chamber on an urgent basis, without the need to go through committees.

The vote was postponed due to the realization that there were not enough votes to pass it. If the base of the Lula government manages to approve the text in the plenary of the Chamber, the text returns to the Senate and can be processed quickly in the House if there is this prior agreement.

Orlando Silva’s statement was given at a meeting of the Esfera Brasil group. The participation of the CEO of Google, Fábio Coelho, was scheduled, but he did not go to the event —he claimed “emergency reasons”, according to the organization of the event.

In his speech, the deputy regretted the absence of the businessman and stated that the company had tried to manipulate the debate on the subject.

Silva said he hopes to approve the text in the Chamber later this month.

Rapporteur for the PL in the Senate, Deputy Angelo Coronel (PSD-BA) indicated at the event that he wanted to understand why the traceability of messaging applications was removed from the Chamber’s text.

He stated that Telegram and WhatsApp messages are a digital “cancer”, due to how easy it is to open an account with a chip and a fake CPF.

At the end of the event, Silva said that he considered that the proposal for traceability provided for in the text of the Senate established an “exaggerated collection” of personal data.

He said he was willing, on the other hand, to include in the text an improvement in the verification of the authenticity of the accounts.

Minister of Secom, Paulo Pimenta also defended the project and said that other countries have sought even more forceful rules for regulating platforms.

One of the main gaps in the text for now is which body will oversee the approval of the law.

Orlando said he accepted the hypothesis of a model called regulated self-regulation, along the lines of what exists in the capital market with Anbima (Brazilian Association of Financial and Capital Market Entities).

The entity performs self-regulation in a market that, in turn, is heavily regulated by public institutions such as the Central Bank —hence the name regulated self-regulation given to the model.

Orlando said that, on the other hand, the body with the most political support for the task is Anatel. He pondered, on the other hand, that there are those who see the agency as captured by the private sector.

The rapporteur also does not rule out evaluating the proposal presented by the OAB and revealed by the Sheet.

According to him, this idea could be “developed” so that there was self-regulation in terms of the financial market, and Anatel, in turn, acted as an external regulator.

For Silva, this could be the way out to vote on the text, since the creation of a new body is seen with bad eyes by the deputies, who say they see a fear of state interference in this path.

Angelo Coronel said he supports the idea of ​​Anatel as a regulator. The Secom minister, in turn, says that it is up to Congress to decide on this point.
