Central president says that union reform should not be a priority – 02/16/2023 – Panel

President of the CSB union federation, Antonio Neto says that the union reform proposal discussed by the other unions is not a priority and that, at the moment, efforts should be concentrated on repealing the 2017 labor reform and on recovering collective bargaining mechanisms.

The Panel revealed this Tuesday (14th) that the union centrals prepared a proposal for union reform which, in a first draft, suggests the creation of a public agency for the self-regulation of labor relations, the reinforcement of collective bargaining mechanisms and the definition of the minimum representativeness cut-off line and the limits of the unions’ mandates.

The discussion has been led by directors of the three largest trade union centrals, CUT, Força Sindical and UGT.

Antonio Neto, who is also president of the São Paulo PDT directory, states that “before renovating the ‘house’ it is necessary to recover the columns and structure of the union movement”, that is, to fight for the recovery of collective bargaining mechanisms in the world of work and rebuild the means of financing the unions that were affected by the labor reform of the Michel Temer (MDB) government.

In this sense, he suggests measures such as the reestablishment of ultraactivity (the extension of the terms of an agreement or convention until a new negotiation is concluded), the resumption of the prevalence of collective forms of negotiation in relation to individual instruments (direct agreements between company and employee ) and the search for a new way to overcome the financial asphyxiation of the unions after the end of the union tax.

These items are present in the initial document proposed by the union centrals, but Neto suggests that they should prevail in the discussion.

“Before messing with what guaranteed our main conquests and our resistance in the last 80 years, it is necessary to defeat what sought our destruction in the last six years”, says Neto.

“Theses of spraying the union structure, of the agreement on the legislature, of the end of the union contribution, of the national agreements supplanting the negotiations of the unions, the criminalization of the movement paved the way for the imposition of the labor reform in 2017, which, in practice , threw millions of workers into informality and unemployment”, he adds.
