Bolsonaro’s judgment: see the setbacks that PDT imposed on the TSE – 06/23/2023 – Power

With a poor performance at the polls, the PDT imposed series defeats on Jair Bolsonaro (PL) on another front: that of Electoral Justice.

Throughout the 2022 election, the party that can now achieve the former president’s ineligibility obtained decisions with a relevant impact on his campaign, such as the veto of lives at the Alvorada Palace and the ban on the use of speeches at the UN General Assembly (United Nations) in advertisements.

In addition, it moved 6 of the 16 actions that require the impediment of the former representative from claiming elective positions.

Among them is the one that the TSE (Superior Electoral Court) began to judge this Thursday (22), in which the PDT claims that Bolsonaro committed abuse of power and misuse of the media at an event with ambassadors, when the then president made attacks on the electoral system.

The former representative’s defense denies this, saying that he did not speak as a candidate and that he sought to open a discussion on the subject.

In the legal field, part of the role of the PDT in the electoral campaign is attributed to the party’s national lawyer, Walber Agra. “In electoral law, either you have a political feeling, or you dance”, he told Sheet.

Bolsonaro’s lawyer, Tarcísio Vieira, attributed in this Thursday’s trial the party’s performance to an attempt to draw attention to his candidate, Ciro Gomes — who obtained only 3.04% of the votes.

See below the setbacks imposed by the PDT on Bolsonaro in the 2022 election campaign.

1) Video takedown of meeting with ambassadors

The then Corregidor General of Electoral Justice, Minister Mauro Campbell, responded to the PDT’s request on August 22 and ordered the removal of videos published on Bolsonaro’s Instagram and Facebook accounts with images of the meeting with ambassadors in Alvorada.

2) Removal of billboards in Brasilia

On September 20, Minister Cármen Lúcia issued an injunction requested by the acronym, ordering the removal of billboards in access roads to the Federal District with slogans alluding to Bolsonaro.

The then president criticized the decision. “People of the common people who put a flag in front of their property, or a billboard, as we have seen all over Brazil, a billboard with the flag of Brazil: ‘God, homeland, family and freedom’ became political propaganda for the TSE “, he said in an interview with Record.

3) Veto the use of the speech at the UN

On September 21, the Corregidor General of the Electoral Justice, Benedito Gonçalves, prohibited the Bolsonaro campaign from using in its advertisements images captured during the president’s speech at the opening of the UN General Assembly, which took place the day before. The decision complied with the request of the PDT.

“The use of images in electoral propaganda would tend to harm equality, as it would make the performance of the head of state, inaccessible to any of the other competitors, be exploited to project the candidate’s image”, justified the magistrate.

4) Veto to lives at Palácio da Alvorada

On September 24, also in an action brought by the PDT, Gonçalves ordered Bolsonaro to stop recording and transmitting electoral lives at Palácio da Alvorada, his official residence, and at Palácio do Planalto, seat of the federal government.

The decision, called outrageous by Bolsonaro, was later confirmed by the full court.
