The defense of former president Jair Bolsonaro told the Superior Electoral Court (TSE) that the draft found in the house of former Minister of Justice Anderson Torres is “apocryphal” and should be disregarded. The proposal for a decree suggested the possibility of establishing a state of defense at the headquarters of the TSE. The demonstration was forwarded this Thursday (19) to the Court, reported the newspaper O Globo.

The Corregidor General of Electoral Justice, Minister Benedito Gonçalves, included the document in a lawsuit against Bolsonaro for alleged abuse of political power and misuse of the media, which could make him ineligible. The defense requests that the draft be excluded from the file. The minister complied with a request from the PDT, which asked for the document to be included in the action on Bolsonaro’s meeting with ambassadors, in which the former president questioned the fairness of the electoral system, held in July last year.

“It is necessary to state that the apocryphal document, attached to the file, was not found in the possession of the Investigated Persons, nor signed by them, and the attached document does not indicate any concrete acts or at least indicia that they participated in its writing or acted to that the measures supposedly intended by the document were materialized in terms of phenomenal reality”, say the lawyers.

At the demonstration, Bolsonaro’s defense further argued that the document never left the Torres residence and was not published. In addition, the lawyers allege that there is “no news of any measure of transposition from the world of the paper draft to that of phenomenal reality, that is, it never went beyond the plan of cogitation”. Torres stated that the document found by the Federal Police in his house was “leaked out of context”.
