The Public Prosecutor’s Office of the Federal District asked the Justice to dismiss a lawsuit in which former President Jair Bolsonaro (PL) is accused of insulting Federal Deputy Maria do Rosário (PT-RS).
In a statement sent to the court, prosecutor Ana Paula Marimon declared that the case has expired and that there is no longer a deadline to punish Bolsonaro. In 2014, the former president stated that Maria do Rosário did not deserve to be raped because, according to him, she was “very ugly” and because she “doesn’t fit” his “type”. The two were colleagues in the Chamber of Deputies.
The process was sent to the Public Prosecutor’s Office on June 28. However, the crime was prescribed since June 21, according to the agency. The filing still needs approval by the Justice.
“From the accurate analysis of the records, it is noted that it is no longer possible for the State to exercise jus puniendi, in view of the prescription of the punitive claim”, says the manifestation.
The action was opened in June 2016, when the First Panel of the STF (Federal Supreme Court) received a complaint offered by the Attorney General of the Republic against Bolsonaro. The accusation was filed in December 2014, on the grounds that the then deputy “instigated, with his words, that a man can rape a woman he chooses and that he understands to be worthy of rape”.
The action was suspended when he took over the Presidency in 2019. The Constitution prevents the President of the Republic, in the exercise of his mandate, from being prosecuted for acts prior to office.
In June, the Supreme Court forwarded the process to be resumed in the Justice of the Federal District. In the decision, Minister Dias Toffoli complied with the Attorney General’s request and declared that the STF no longer had competence to analyze the case.
