Beto Richa receives pension again as former governor – 07/11/2023 – Panel

Federal deputy Beto Richa (PSDB-PR) is among the five former governors of Paraná who once again received a special pension of R$33,000 for having been heads of the state executive branch. In May, when Sheet revealed the decision of the 2nd Panel of the STF (Federal Supreme Court) authorizing the resumption of payments to seven former governors of Paraná, Richa said that he had not yet decided whether he would exercise the “right reestablished by Justice”. Payment had stopped in February 2020.

This week, Seap (Secretary of State for Administration and Social Security) confirmed to the Panel that the decision of the 2nd Panel has already been complied with and payments are being made to five former governors: in addition to Beto Richa, Orlando Pessuti, João Elisio Ferraz de Campos, Paulo Cruz Pimentel and Mario Pereira. Two former governors who also appeared in the complaint to the 2nd Panel of the STF, filed in 2020, died in 2021 — Jaime Lerner and Emílio Hoffmann Gomes.

According to Seap, the five politicians have already received two payments since the decision of the 2nd Panel – on May 31 and June 30 – in the amount of R$ 33,924.93. Information on this year’s payments was not yet on the Transparency Portal website of the government of Paraná, in the space that deals with personnel remuneration, until the afternoon of this Tuesday (11).

Richa’s advisor sent a note to the Panel, explaining that the initial amounts were allocated to legal fees and that he is now looking for assistance entities to make the monthly donation of the special pension. The note also says that the deputy’s intention is to continue with the practice of making donations “while he is occupying an elected office”.

Richa governed Paraná twice, between January 2011 and April 2018. In his first term, in March 2011, he signed a decree suspending the special pension for former governors who held office after 1988, claiming that the benefit was illegal . Later they got the benefit back. And Richa himself, in January 2019, also started to receive the special pension.

But payments to former governors were again cut in February 2020, in the wake of a December 2019 decision by the STF plenary that declared the benefit unconstitutional. At that time, most ministers also understood that the amounts already paid up to that point did not need to be returned, simply interrupting new payments. But a group of seven former beneficiaries filed a claim to continue receiving the money. The case was analyzed by the 2nd Panel, and not by the plenary.

In April 2023, by majority, the ministers of the 2nd Panel determined the immediate reestablishment of the payment of the benefit to the group. Despite this, the prediction of the benefit in an article of the Constitution of Paraná remains unconstitutional, according to the 2019 decision of the plenary. That is, future former governors will not have the right.
