Bench defends minister at TSE against Moraes candidate – 05/04/2023 – Mônica Bergamo

Parliamentarians who are part of the Women’s Bench of the Chamber of Deputies appealed to the president of the STF (Supreme Federal Court), Rosa Weber, in defense of the appointment of the substitute minister Maria Claudia Bucchianeri Pinheiro for an effective vacancy in the TSE (Superior Electoral Court).

EXPECTATION

The letter was also sent to other judges of the STF. Currently, Bucchianeri is a substitute for Minister Sérgio Silveira Banhos, whose mandate will end on the 17th of this month. According to the tradition of the electoral court, she should rise to the rank of holder – but an appointment by the president of the TSE, Alexandre de Moraes, could break the rite.

As revealed by UOL, Moraes has been working to nominate lawyer Floriano de Azevedo Marques, former director of the USP Faculty of Law, for the chair of Baths. The magistrate would be concerned about the fate of important actions that will be judged soon, such as the one that will discuss the ineligibility of former president Jair Bolsonaro (PL), and would like to have someone he trusts in the post.

The deputies also request that, if Bucchianeri is named effective minister of the electoral court, the STF consider voting on a triple list “exclusively female” to take her place as a substitute.
