Minister Flávio Dino, of Justice and Public Security, tried to justify, this Friday morning (3), the reason for having agreed to decree a Law and Order Guarantee (GLO) operation in ports and airports in the states of São Paulo and Rio de Janeiro, even though it was against it during the events of January 8th, in Brasília.

Last Wednesday (3), without responding to journalists, President Luiz Inácio Lula da Silva (PT) decreed the operation following requests for help from Rio de Janeiro governor Cláudio Castro (PL-RJ) for more security in the state, which is experiencing a wave of violence by militiamen. Lula had said, the previous week, that he would not make an intervention or GLO in Rio.

Dino says that the change of mind about this type of operation occurred due to “different circumstances”, in which the acts of January 8 were political and that the wave of violence is now a question of “sovereignty”.

“At that moment on January 8, in fact the GLO was not adequate because there was a political split planted by right-wing extremism within the Armed Forces, in an eminently political movement,” he said in an interview with Brazil 247.

According to him, the circumstances led to a change in assessment and made the decree of a Guarantee of Law and Order now because they affect the issue of territoriality – “we have territorial control by factions”, he said – which affects the very national jurisdiction over territory dominated by organized crime.

Flávio Dino highlighted that the GLO is not about the capitals or states of São Paulo and Rio de Janeiro, but only in areas under federal administration, such as ports and airports. “There will be no Army, Navy or Air Force operating in police areas, such as communities, neighborhoods, streets and avenues”, explained the minister, highlighting that the policing carried out in federal areas is the responsibility of the Federal Police, which, he says, “is overloaded” .

The minister also explained that this work to reinforce policing began this Friday (3) with a police operation in Bahia, in search of faction leaders who had served two arrest warrants, and security actions in Rio to the Copa Libertadores final, on Saturday (4), between Fluminense and Boca Juniors.

Flávio Dino also stated that the GLO decree will be valid in principle until May 2024, since, according to legislation, there must be a deadline for this type of operation. However, he says, the operation can be prolonged if necessary.

“It is a way to minimize risks, for example, which are occurring in Guarulhos [Aeroporto Internacional de São Paulo] changing luggage, placing illicit substances in travelers’ suitcases that have nothing to do with the criminal chain, further improving the inspection and monitoring of cargo transit, and, therefore, will not affect the civilian population”, he highlighted.

Permanent guard

Still during the explanation about the difference between the Law and Order Guarantee operation now and not on January 8, Flávio Dino stated that he would like to create a permanent civilian National Guard to replace the National Force, which acts when requested by state governments. in extreme cases of need.

“The National Force is nothing more than a temporary recruitment of police officers from the states, and there is a limit to that. States do not have the capacity to provide us with unlimited human resources,” she said.

According to the minister, the permanent National Guard would be formed through a public competition for the training of personnel and would prevent states from “borrowing” contingents and being unmanned by security agents.

Flávio Dino explained that there is a gap left by the 1988 Constitution, which defined that overt patrolling is a responsibility of the state police, but that it has not been sufficient and that the Federal Police itself has also started to act – which contradicts the definition of judicial police. . This gap, he says, would be filled by the permanent National Guard.
