Minister Luís Roberto Barroso, of the Federal Supreme Court, was chosen as rapporteur for the habeas corpus filed Wednesday by the defense of former Minister of Justice Anderson Torres – imprisoned for over a hundred days on suspicion of omission in the face of the coup acts that devastated the Praça of the Three Powers on January 8.
The request for freedom collides with Minister Alexandre de Moraes, who had decided to maintain the preventive detention of the ally of former President Jair Bolsonaro (PL). The defense alleges that Torres had an “anxiety crisis” on Tuesday, at the Military Police Battalion in Brasília, where he is being held – when he “cried compulsively, reporting an enormous longing for his family, especially his daughters , exposing unrelated words and ideas, and exposed his dismay with the maintenance of his life”.
“The deleterious effects of precautionary custody can lead the patient (Torres) to take his own life. according to the doctor from the Health Department of the DF, lies in his home hospitalization”, argue lawyers Eumar Novacki and Edson Smaniotto, who represent Bolsonaro’s former minister.
The habeas corpus questions the fact that Alexandre de Moraes denied, on the 20th, another request for Torres’ freedom, which had a favorable opinion from the Attorney General’s Office (PGR).
The institution defended that Torres be placed on provisional release, but with alternative precautionary measures such as the use of an electronic anklet and maintenance of his removal from the functions of Federal Police delegate – a career to which he belongs.
By keeping Torres in prison, the minister considered that the Bolsonarist’s need for segregation was reinforced by “strong indications” of his connection with the “draft of the coup” – a document seized by the Federal Police in a closet at Torres’ residence, in Brasília – and with the mass inspections by the Federal Highway Police in the second round of elections.
At the time, Alexandre classified the PRF’s serial blitzes, especially on highways in the Northeast – President Lula’s main electoral stronghold – as a “coup operation to try to subvert legitimate popular participation”.
The former Minister of Justice would testify on Monday about the performance of the PRF in the second round of the election – the corporation is subordinate to the Ministry of Justice.
The hearing, however, was postponed after the Health Department of the Federal District attested that Torres is unable to “attend any hearing for medical reasons (medication adjustment), for a week”.
