The Amnesty PEC, which should be approved in the first stage on Tuesday (16) by the Chamber of Deputies, can free parties that have committed the most diverse irregularities over the years from punishment, which includes the use of public funds for unmotivated purchases. four tons of meat in one year.
The TSE (Superior Electoral Court) concluded this month the judgment of the accounts of all parties relating to 2017 —the lack of structure of the Justice makes the analyzes occur with a delay of almost five years—, disapproving 19 of them and approving 16 with reservations.
One of the most emblematic cases is that of Pros, created in 2013 and incorporated this year into Solidariedade.
Reported by Minister Alexandre de Moraes, president of the TSE, the judgment that rejected the party’s national accounts and condemned it to return R$ 2.4 million to public coffers lists a list of irregularities, most of them linked to the suspected use of the public money for the benefit of the then president of the acronym, Eurípedes Jr.
Among them, the construction of a swimming pool and the carrying out of renovations in his house, the purchase of an industrial machine for polishing floors, expenses with the purchase and maintenance of an airplane and helicopter, in addition to the acquisition of machines, utensils, personnel and typical inputs of a professional restaurant.
TSE technicians reported during the trial that in Planaltina de Goiás, land of Eurípedes, the Barbecue Biroska operated at the same time, owned by a former partner of the leader.
The Pros denies that the meats were destined for the steakhouse, claims that the stable union between the two ended in December 2016 and that all acquisitions were for the kitchen set up by the party for directors, employees and guests.
Among the items purchased with public money were an electric oven, 100 table dishes and 100 dessert dishes, an electric steak maker, deep fryer, buffet equipment with 18 vats for displaying hot food and salads, a machine capable of producing 50 kg of ice per day , butchery, fishmonger, barbecue knives, cleaver, vases, porcelain for creme brûlée dessert, wine and water glasses, olive oil cruets, cooking torch, frying pans, casseroles, baking tins, among others.
A chef and a waiter were also hired by the Pros, with salaries that totaled R$48,000 for the year.
The party also spent another BRL 135,000 on food, with an emphasis on 3,700 kilos of meat – around 10 kg per day, including holidays and weekends.
Sandra de Oliveira Caparrosa told the Sheet that the relationship with Eurípedes Jr. was dismantled in March 2017 and that neither before nor after that did any penny of the party be used in its establishment, which already existed and had been equipped for years.
“It’s a restaurant that comes from my family, my mother’s company, on my mother’s property. Eurípedes Jr. and Pros had no participation in anything. On the contrary, the restaurant financially leveraged the trips for the creation of the party, the food for the people who worked on the creation of the party”, stated Caparrosa.
The technical area of the TSE states in the report that “no documents were presented to prove the use of such equipment purchased with public money in party activities”, and “party employees receive food vouchers, not justifying the aforementioned expense”.
Alexandre de Moraes wrote in his vote that the purchased materials have nothing to do with party activity, as well as the hiring of a chef and waiter and “the acquisition of foodstuffs in the amount of R$ 134,660.47, in view of the purchase of, between other items, 3,700 kg of meat”.
The PEC (proposed amendment to the Constitution) has the support of the government and the opposition and should be approved this Tuesday at the Constitution and Justice Commission of the Chamber, the first step in the process.
Signed by 184 deputies, including government leaders, José Guimarães (PT-CE), and opposition leaders, Carlos Jordy (PL-RJ), the PEC prohibits any punishment for illegalities committed until its enactment, including disrespect for the minimum transfer funding for women and blacks in elections.
In the analysis of the Pros’ accounts, the TSE also pointed out the suspected use of another R$ 328,000 of money from the party fund in renovations at the party president’s house, in Planaltina.
The technical area, in addition to pointing out the absence of documents that prove the regularity of the application of resources, cited a police investigation in which an architect and several former party employees reported having provided private services to Eurípedes, receiving a salary from the Pros.
The architect, for example, said she had designed the swimming pool and architectural consultations for the barbecue area at Eurípedes Jr.’s house.
“Leôncio Bernardo Amorim, a party official in the role of painter, declared (…) that he even worked at Eurídes Júnior’s residence during the excavation of the hole where a swimming pool would be placed, that he even carried out the finishing of the swimming pool, which lasted for about three months, that together with the deponent there were about seven people working, all Pros employees”, reported the technical area of the TSE.
Another irregular use of public money by the party, according to the TSE, occurred in relation to the acquisition for BRL 404,000 of the PT-VQW twin-engine plane, in addition to BRL 180,000 for fuel, pilot salaries and maintenance of a Robinson helicopter. Model R66, also obtained with party fund money in previous years and also considered irregular by the TSE.
“It was found that the party helicopter made 101 flights, 60 of which were round trips from Planaltina to Valparaíso/Goiânia and 25 referring to the stretch from Planaltina to Lago Sul [de Brasília]whose distance covered is 68 km”, says the court report.
Moraes concluded his vote, which was followed by the other ministers of the court, applying the maximum fine, 20%.
“The party has serious flaws against itself (…), cash outflow from its account related to the acquisition of a twin-engine plane and, mainly, private expenses of the president of the association paid through public resources. (…) In this way, I understand proportional to the fine of 20%, considering the very serious nature of the faults found, which are not in line with the democratic political-electoral system.”
Pros say they excelled in legality and economy
In a note signed by lawyer Paulo Henrique Gonçalves, the Pros stated that their expenses were related to party activity and that they always prioritized legality and economy in the use of public funds.
Regarding meat and other expenses typical of a restaurant, he stated that they were all directed towards setting up their own kitchen to feed managers, employees and guests.
“The party clarifies that it has always prioritized legality and economy, like the meat, although it was not ‘tons’, these were used to feed employees and members. -wife of the president, who separated in 2016, and the acquisitions were later”, says the text.
Pros also states that the “allegation of renovation of the president’s house was fabricated by former members of the party who tried, through untruths and at all costs, to take over the national direction of the party, according to articles published by the same Folha de S.Paulo“.
Finally, the lawyer states that the helicopter “was used for the growth and strengthening of the association throughout Brazil”.
