Alternate member of Podemos says that vacancy in the Chamber is indisputable

Former federal deputy Luiz Carlos Hauly (Podemos-PR) emphasizes that the vacancy left in the Federal Chamber by Deltan Dallagnol belongs to the party. “That is indisputable,” he assures. First alternate, Hauly confirms that Podemos’s lawyers are taking the appropriate measures to ensure that the seat is not taken from the party after Dallagnol’s candidacy was challenged by the Superior Electoral Court (TSE) this Tuesday (16).

One day after the TSE’s decision, the Regional Electoral Court of Paraná (TRE-PR) determined that whoever should take Dallagnol’s vacancy is Itamar Paim, 1st alternate of the PL in Paraná. This is because, according to the TRE, Podemos did not reach the minimum percentage of 10% of the electoral quotient, the so-called barrier clause, which in 2022 stood at 201,288 votes.

Hauly had 11,925 votes, 8,200 short of the minimum required. Paim, with just over 47,000 votes, would meet the requirements to take office if considered the representation of the PL in the house.

“Deltan still has the possibility of returning, the party’s lawyers are working to reinstate his vacancy. We have this first step to complete. But it is certain that the vacancy belongs to the party”, emphasizes the first alternate of Podemos, who has already been federal deputy 7 times consecutive, in addition to 2 times Secretary of State for Finance of Paraná.

Hauly recalls that there is an understanding of the Federal Supreme Court (STF) on the non-applicability of a barrier clause for alternates. And he considers that the decision of the TRE-PR violates the decision of the TSE in maintaining the votes for Podemos.

“It goes against common sense and the Constitution, because there is no barrier clause in the constitutional text. The majority vote is for president, mayors and senators. For state and federal deputies and city council members, proportionality applies, that is, each party assembles its ticket and is entitled to the number of seats plus one, and we fill that in”, he explains, mentioning the validation of the votes of all 31 candidates from each party. and vote legend to fill the 30 vacancies destined to the State in the Chamber of Deputies.

For the former deputy, the “taking” of the seat, as he considers it, would be a greater loss to the party than to him personally. “I had my terms, I have my career. I am the father of Simples (referring to the Simples Nacional collection system) and MEI (individual micro-entrepreneur modality), creator of the Tax Reform. Of course, a mandate is always an honor, but it doesn’t add to my salary, after all I already have remuneration and it wouldn’t accumulate. I would only contribute, as Deltan was making its contribution in the Legal field”, he concludes.

Gazeta do Povo contacted TRE-PR to comment on the criteria for the decision, but there was no response until the publication of the report.
