Allan dos Santos becomes defendant in Federal Court for threatening Barroso

The 10th Panel of the Federal Regional Court of the 1st Region (TRF1) accepted the complaint offered by the Federal Public Ministry (MPF) against journalist Allan dos Santos, founder of Terça Livre. He is accused of the crime of threatening Minister Luís Roberto Barroso, of the Federal Supreme Court (STF).

With the decision, Allan Santos becomes a defendant and will respond in Federal Court for the crime of threat. If convicted, the penalty may vary from 1 to 6 months in prison, in addition to paying a fine.

In accepting the MPF’s appeal, the case’s rapporteur understood that there were sufficient elements to receive the complaint, as there were signs of threat not only in the words spoken by the blogger on his YouTube channel, but also “by the gestures and the personal expression of affront”. . Therefore, he determined the continuation of the action so that the case is analyzed from the collection and analysis of evidence.

In the complaint, the MPF pointed out that, on November 24, 2020, the journalist published on his channel Terça Livre, on YouTube, a video in which he challenged the minister to face him personally. In the recording, the MPF explains that “Allan dos Santos used words of hate, bad slang and, in a clearly threatening tone, asserted that he would be capable of harming Barroso”.

For the MPF, the facts do not consist of mere political criticism, but of criminal conduct. “Abusing his freedom of expression, an influencer uses his community to convey promises of violence to an authority”, says the MPF in the appeal.
