AGU asks for compensation of BRL 20.7 million and final conviction of suspects from 1/8 – 02/13/2023 – Power

The AGU (Advocacy-General of the Union), the body that legally represents the federal government, asked the Justice to convert a precautionary action (urgent measure) that blocked the assets of suspects of financing the charter of buses for the coup acts of the 8th of January in a process that guarantees the final condemnation of reimbursement to the public coffers.

The amounts of this compensation are R$ 20.7 million and were calculated based on the losses pointed out by the STF (Federal Supreme Court), Palácio do Planalto, Chamber of Deputies and Senate.

The AGU’s request also rectifies the number of people and companies that had their assets blocked initially in the process. They went from 52 individuals and seven legal entities to 54 individuals and five legal entities (three companies, one association and one union).

According to the agency, this happened because some of the suspects in the original action “provided clarification and demonstrated that they had no involvement with the acts of January 8, including, in some cases, indicating who were the real contractors of the buses”.

The request awaits decision of the Federal Court of the Federal District. The AGU says, in the action, that it is an illegal act when someone who has the right to free demonstration and peaceful assembly “manifestly exceeds the limits imposed by their economic or social purpose, by good faith or by good customs”.

“In a democratic regime, as in the Brazilian system, it goes against the customs of democracy and good faith to summon and finance a movement or demonstration with the intention of taking power, a situation that demonstrates the illegality of the event that occurred”, says the agency. .

“[Os suspeitos] were aware that the movement in organization could cause the event as it happened is reinforced when we compare what was verified with the calls/convocation to participate in the event, when express reference was already made to designs of non-peaceful acts (or of dubious peacefulness) and power grab”, says the AGU.

“[Isso] demonstrates an articulation prior to the movement with a non-orderly purpose, with the financing of transport being a primordial vector for it to take shape and materialize in the terms that occurred.”

So far, the AGU has filed four civil lawsuits regarding those suspected of financing or participating in the acts that destroyed the headquarters of the three Powers. In three of them, the assets have already been blocked.
