The Federal Court of Auditors approved in a plenary session, on the 17th, some changes to Normative Instruction (IN) No. 93, after the Novo party bench demanded changes to the rules for monitoring and transparency of special transfers (PIX amendments).

According to the party, the TCU’s decision was motivated, in particular, by the approval of a request from the Financial Inspection and Control Commission (CFFC) with the aim of the TCU ensuring that the execution of these resources occurred in the most transparent manner. possible.

“The transfer of amendments through special transfers as was being done, without any type of supervision, could generate serious problems, such as the lack of control over the allocation of resources, the occurrence of deviations and irregularities and also the difficulty of evaluating the effectiveness of public policies. The changes approved by the TCU represent a major advance in transparency in the management of these resources”, declared the leader of Novo, deputy Adriana Ventura.

With the changes, the transfer to states and municipalities, through a parliamentary amendment, must have an electronic management report completed on the official platform (Transferegov.br) by the benefiting city halls and state governments.

The report must be inserted into the platform by June 30th of the year following receipt of the special transfer. Previously, it was possible to include information on the platform, but it was not mandatory.

A period of 60 days was also stipulated for the executive – municipal and state – to insert documents and information about the execution of resources, such as: a description of the object to be executed, with the goals to be achieved; the estimate of the financial resources necessary to achieve the objective; the budgetary classification of the expenditure; in addition to the expected deadline for completing the object.

With this measure, the TCU will be able to verify whether entities are complying with the requirements set out in the Federal Constitution. It is up to the body to create, at the federal level, appropriate mechanisms for monitoring transfers, as well as carrying out audits and inspections to verify the application of resources.

Pix amendments or special transfers made by parliamentarians to their base municipalities increased by 530% between 2022 and 2023, jumping from R$1.5 billion to R$8.1 billion. In addition to being a strategy to boost candidacies, the increase also reflects the increasing trend of control that the National Congress has sought to exercise over the public budget.

The changes have already been in force since the day of approval by the TCU, that is, all transfers made since January 17, 2024 must follow the new regulations. The new rules also apply to transfers carried out previously, in cases where the objects have not yet been completed.
