After Deltan, deputy wants to invalidate impeachment without deadline – 06/06/2023 – Panel

Congressman Sóstenes Cavalcante (União-RJ), a member of the Board of Directors of the Chamber, proposes a way to invalidate candidacy cancellations after the registration deadline.

The initiative is a reaction to the loss of mandate of Deputy Deltan Dallagnol (Podemos-PR), who had his candidacy registration rejected on May 16, two and a half months after taking office.

Electoral legislation determines that registrations, including contested ones, need to be judged up to 20 days before the elections. The resolution of the TSE (Superior Electoral Court) nº 23.674 of December 2021, which established the schedule of the last election, stipulated September 12 as the deadline.

“As a deputy, if I miss any deadline, the TSE makes me unfeasible, punishes me. And if the TSE fails to meet the deadline, nothing happens?”, asks Cavalcante.

The parliamentarian does not know whether he will propose a bill, given that the rule is already included in the electoral legislation, or whether an internal draft resolution of the Chamber, to discipline how cases like Dallagnol should be evaluated.

There was a forecast that the Board of Directors of the House would meet this Tuesday (6) to evaluate the decision of the TSE. Until the afternoon of Monday (5), however, the deputies had not yet been summoned. President Arthur Lira (PP-AL) suspended face-to-face sessions this week.

It is up to the Board of Directors to evaluate the Internal Affairs’ opinion on the Dallagnol case. As it is a matter of revocation of the registration, and not of the mandate, the assessment of part of the members is that it is not up to analysis of merit, only to accept or reject the decision of the TSE.

Sought, the Chamber’s corregidor, Deputy Domingos Neto (PSD-CE), did not say what his opinion should be because the process is confidential. But he assured that he will be ready, in case Lira calls the meeting for Tuesday.
