The Chamber of Deputies resumes, this Friday morning (7), the analysis of the highlights of deputies to the Proposed Amendment to the Constitution (PEC 45) of the tax reform, approved on Quita night (6) and this morning by 382 votes in the first inning and 375 in the second. The dissenting votes were 118 and 113, respectively, with 3 abstentions.

The session this Friday (7), scheduled for 10 am, will analyze four of the five highlights proposed by the deputies after the second round of voting, which were pending the morning session ended by President Arthur Lira (PP-AL) at 2 am. In the first round, the parliamentarians had seven highlights knocked down.

The text had the rapporteur of deputy Aguinaldo Ribeiro (PP-PB). The author of the measure was Deputy Baleia Rossi (MDB-SP).

After approval in the House, the PEC and the highlights go to the Senate for consideration, where it will also need to be approved in two rounds before enactment.

Still in the first round, the Chamber also approved an agglutinative amendment, which is the text with all the changes that were agreed between the deputies and the rapporteur. There were 379 votes in favor and 114 against this topic.

This Friday morning (7), President Luiz Inácio Lula da Silva (PT) celebrated, on social networks, the approval of the text by the Chamber. “Congratulations to the Chamber of Deputies for the significant approval yesterday and to Minister Fernando Haddad [da Fazenda] for their commitment to dialogue and the advancement of reform,” he said.

During an event on Thursday (6), Lula recognized that the text is not exactly what the government wanted, but what was possible in a process of correlation of forces with Congress.

Amendments and agreements ensured approval

Last-minute deals and the release of BRL 5.3 billion in amendments to parliamentarians helped secure approval. The changes in PEC 45 were the result of negotiations involving party leaders, governors and representatives of the productive sector, such as agribusiness.

One of the last changes in Ribeiro’s opinion was the introduction of a safety lock to avoid increasing the tax burden with the changes that will be introduced in the Brazilian tax system. Last year, cargo accounted for 33.71% of GDP, according to the National Treasury Secretariat (STN).

Other changes involve a zero rate for the national basic food basket; the entry into force, at the same time, of the Contribution on Goods and Services (CBS, of a federal nature) and the Tax on Goods and Services (IBS, of a state and municipal nature); the extension until 2032 of the decoupling of municipal revenues; the automatic transfer of taxes to the municipalities and the maintenance of fiscal benefits for the Free Zone of Manaus and for Simples.

The rapporteur also responded to requests from the governors to improve the composition and deliberation rules of the Federative Council, which will have 27 members for each federative entity. The deliberations will have to be approved by the absolute majority of the representatives.
