Manaus (AM) – The Brazilian Association of Electric Energy Distributors (Abradee) went to the Federal Supreme Court (STF) to request the annulment of State Law No. Águas de Manaus, to notify ten days in advance about the inspections.

The Association used as an argument in the STF, that the warning time is enough for those suspected of stealing and tampering with energy to break up irregular connections, the famous ‘gato’.

“The prior notice will alert any violator to carry out the inspection or inspection 10 days in advance, suitable time and more than enough to undo any changes/interventions in the measurement systems”, says an excerpt from the Direct Action of Unconstitutionality (ADI), which is being reported by Minister Luiz Fux.

Abradee declared that the state deputies invaded the competence of the Union to legislate on electric energy. “The Amazonas Law in focus clashes with the constitutional provision that only the National Law will provide for the regime of concessionaires and permit holders of federal public service, and on the rights of consumers of these services”, she said.

In statements to In timethe advisory of deputies Roberto Cidade and Mario César Filho stated that the Association did not contact Aleam, nor with the ALE-AM Consumer Defense Commission, in which state deputy Mário César Filho is president, in order to deal with the law in question.

“As for the fact that the Association goes straight to the STF, I consider it a natural attitude, since it represents the interests of energy companies. I believe that there is no unconstitutionality in the law that is intended to be overturned by the STF, however, the defense of consumer rights will continue to be carried out, through the Consumer Code and state laws,” said deputy Mario César Filho.

State Law No. 5,797, of February 23, 2022, was approved by the Legislative Assembly of Amazonas (Aleam) in December 2021 through a proposal presented by state deputies Sinésio Campos (PT), Carlinhos Bessa (PV) and former deputy Dermilson Chagas (Podemos), at the time president, rapporteur and member, respectively, of the Parliamentary Commission of Inquiry (CPI) of Amazonas Energia, in the Legislative Assembly.

It orders consumers to be notified via Acknowledgment of Receipt about all details of the inspection (place, date and time) 10 days in advance.

CPI of Amazonas Energia

The Parliamentary Commission of Inquiry (CPI) of Amazonas Energia began on October 20, 2021 and ended on May 31, 2022, where irregularities in the generation and distribution of electricity in the State of Amazonas, as well as the cost of electricity.

With the conclusion of the CPI, the final report was approved, which proposed the signing of a Term of Adjustment and Conduct (TAC) between Amazonas Distribuidora de Energia SA and the State Public Ministry.

According to Abradee, in Amazonas, 44% of the energy purchased is the result of diversion and/or theft. The entity declares that the “survey, inspection, inspection, recovery and collection of this stolen energy is guaranteed for the sustainability of the public service for all users”.
