The target of a lawsuit worth around BRL 40 billion, Petrobras held its breath with a decision by STF Minister Dias Toffoli, who paralyzed the trial of the lawsuit in which workers complain about a supposedly bad settlement of accounts with the oil company.
At the center of the dispute is the so-called RMNR (Minimum Remuneration of Level and Regime), created by collective agreement and which was in force between 2007 and 2011. base salary, had the role of equalizing the remuneration of employees.
Employees claim that Petrobras overpaid throughout the period, a figure that, added up, would result in about R$ 40 billion.
There were disagreements about the calculation of the RMNR that ended up in court. In 2018, the TST (Superior Labor Court) ruled in favor of the workers, forcing Petrobras to pay the payment.
The state-owned company then appealed to the Supreme Court, with the argument that the TST had “offended the freedom of negotiation” between the parties.
Although most of the ministers of the first panel of the STF voted in favor of Petrobras, lawyers for the parties claim that, behind the scenes, Minister Toffoli can take the case to be decided by the full, which puts the state-owned company again in front of a scenario of uncertainty.
The lawyers also consider that, with the arrival of Cristiano Zanin at the STF, there will still be the possibility that he will also ask for a visa to familiarize himself with the cause, which would open space for a possible mediation between the parties.
